Tier 2 PBS Dependant Visa - documents checklist?

Hi all

We have just submitted a Tier 2 PBS Dependant Visa from within the UK (I have applied for and been granted my visa seperately)

The document checklist provided after the application by UKVI only shows:

- Passport
- BRP
- Evidence of £630 savings
- Bank statements

There isn't any section on proof of relationship etc. We will provide those docs anyway, but perhaps have we submitted the wrong application? I would have thought there would have been an extensive list of requirements: phne bills, tenancy agreements, joiin bank accounts etc.

Thank you - the bit I was worried about was that the document checklist didn't specify that we needed to. I was worried that we have submitted the wrong visa type, we applied for 'PBS Dependant - Partner'

It is the correct visa.

The checklist for some reason doesn't list the cohabitation requirement but subsisting relationship must be proved.

Hi all

my partner has applied for her Tier 2 PBS Dependant from within the UK (I have applied and received mine seperately).

We are close to the expiry of her Tier 5 visa but, have booked 1 day processing for her Tier 2 PBS dependant visa at a biometrics appointment just prior to the expiry date of her Tier 5 visa.

i) if the Tier2 PDB dependant visa takes longer to process (ie after her Tier 5 has expired), can she still remain and work under the Tier 5 visa pending the dependant visa outcome?

ii) if the dependant visa application is declined, and we decide to appeal/re-apply, can she continue to remain and work under the Tier 5 visa until we hear a new outcome?

Thanks for any help, we appreciate it

Date of application is the date you submit and pay online. The appointment date is irrelevant.

If she applied in time, she is protected under Section 3C of the immigrations rules which means her existing tier 5 visa conditions continue while HO processes her application for a dependent visa.

There is no appeal right for refused pbs route applications. If her visa is refused, she might have the option of admin review if you believe HO made an error.

She will have 14 days to do either at or reapply. While this happens she will be an overstayer and likely won't be able to work until she gets a positive outcome.

Thank you CR001- you have been a god send so far.
If i could ask you one more thing..

We have submitted/paid the application online, but haven't done any of the evidence, biometrics etc yet. Is she able to travel out of the country briefly without her application being abandoned?

I have done lots of searching about this and there is a huge amount of conflicting info online.

I attended the biometrics appointment yesterday for the same visa. I got the exact same document checklist. The bloke who was taking my biometrics was staggered I had uploaded more documents than what was listed. He wasn’t going to upload them at first. Only after I insisted that according to my own reading etc regarding proof of relationship / cohabitation did he agree. I had collected about 180 documents in total as well.

I just find this entire process an absolute joke. Inconsistent information, inconsistent terminology, no opportunity to speak to anyone who actually understands the process, and outright wrong information (as per the above checklist).

There aim seems to make it as difficult and complicated as possible to catch people out. Those that collect biometrics have no idea as they are a separate company. I just hope he actually submitted them all.

Make sure you include all your documents.

Probably. But I’d rather go more than less. Especially as it seems common for people to be denied for not including enough evidence.

I don’t believe the rules are clear at all.

Take the checklist for example. Why not include “evidence of cohabitation” or “evidence of subsisting relationship” as a requirement?

Why is “enter to leave” and “enter to remain” used interchangeably?

Why use “family member” and “partner” as separate identities in some points, but not others?

Why outsource to a company who don’t know the rules?

I’m a Masters educated professional with English as my first language and I find the entire system difficult to navigate. Heaven help those coming from non-English speaking nations.
