Tier 2 General Extension (change of employment)

Hi

Hoping to get some clarity on my Tier 2 general status.

Current status:
  • Tier 2 General valid until 27/08/19 (entered the UK on 29/7/14)
    Employment ended 28/02/2019 (I did not receive a curtailment letter from Home Office)
    I have secured new employment and I should be exempt from the Tier 2 cooling off period as a ‘high earner’.


My questions are:

1. Has my visa already “ended” even though I did not receive a curtailment letter from HO?
2. Do I need to leave the UK and re-enter as a visitor when my visa ends on 10/8 (5 years and 14 days)?
3. Am I eligible to apply for a Tier 2 extension for a change of employment or do I need to apply for a new Tier 2 General? My assumption would be if the answer to #1 is 'yes' then I would need to apply for a new Tier 2 General.

1. Your visa ends when HO sends the curtailment letter if your visa is valid for more than 60 days at that point. Have you checked with your sponsor that they did notify HO within 10 days of your last work date?? Does HO have your correct address?? If they do not have your current or correct address, then any letter would be sent to what they previously had on their system.

2. No. Why would you need to come back as a visitor?? You cannot switch to tier 2 from visitor visa anyway.

3. It is a new tier 2 visa but for changing employer, done within the UK.

1. My sponsor did notify HO. Good question re: correct address. I assume this was something I needed to do myself when I moved (but did not).

2. Apologies I did not mean to imply I needed a visitor visa but I understand what you are saying.

3. Ok and given your reply to #1 I will apply for a new Tier 2 general visa.

Yes, there is a specific form that has to be completed for HO to update your address.

Is your job a shortage occupation SOC or a non shortage occupation??
