Dear friends,

I wonder how tax issues may affect Spouse/family-based ILR. How will the HO see undeclared income or unpaid tax in relation to those ILR applications providing that the tax issues are not criminalised and they are not related to meeting financial requirements either? The 322(5) cases have somehow indicated that the HO do see tax issues as an indicator of good character, so what if one happens to have some tax issues that needs to be retrospectively fixed?

It's bit contradictory. On one hand, I guess tax debt is normally civil whereas the 322(5) cases are seeing it as as serious as 'non-conducive to public goods'.

3. The tax issue refusals were specifically related to a different visa category, ie Tier 1 General.
