Switching from Tier 2 to Skilled Worker Visa with a new sponsor

Post by mussiD » Mon Jan 17, 2022 11:18 am

Dear all,

I am now in the process of changing my sponsor. I am on Tier 2 visa with Sponsor A and switching to Skilled Worker Visa with Sponsor B. I have following questions, I would be grateful if you could help:

1. The start date of my employment with sponsor B is in mid Feb (as per employment contract and COS) but judging by how they are handling this I do not think I can get my visa approved by then. I have already given my notice to employer A. My question is can I start at sponsor B in mid Feb even though my visa will be pending at Home office?

2. While working at sponsor A, I got married in my home country last year and now have a son. I have not applied for dependent visa yet as I have been regularly travelling (working from home in my home country) and waiting for better opportunity. As this better opportunity has now come up (sponsor B) I want to apply for dependant visas for my wife and son at the same time as my application. My question is can I apply for priority visa for myself (as my visa is urgent due to above reason) but for standard visa for my wife and son as I am planning to bring them later (accompanied by me)?

Thanks in advance for your replies.

1. No, you can only work for your new sponsor once your visa has been approved.

2. You should apply for dependents once your visa has been received

Thanks for your reply.

Can I ask further Reg 2:

So new employer cannot/should not include my wife and son (as a dependant) in COS, is that correct?

Also, later when they apply for their dependent visas from my home country, they will have to either show maintenance funds in a bank account or a maintenance letter from my employer that their expenses will be covered in case such need will arise, am I correct?
