Dependant Visa - Switching Query

Hi All,

This query is for my Wife Visa.

My wife came to UK on March 2024, and that time I was having Skilled worker visa, so she came as a dependant back in March 2024.

Post that I have applied and got ILR on May 2024 (as I have used 1 day service), and on June 2026 I have obtained British citizenship.

Query:

1) Her Visa is due for renewal in Oct 2026, so do I need to apply for FLR (M) or any other Visa Type?
2) Does her Clock for ILR reset back to Zero if i apply for new category (considering I can't apply on same previous category as I am no longer Skilled worker) and does she needs to wait more 5 years after her new Visa category?

Your dependent applies to extend their skilled worker dependent visa for 3 years. The rules allow this if you have ILR.

No need to switch visa categories.

Currently I am having British citizen, so can she still extend for same category what she done in 2024?

Also one more query, my wife's Dependant Partner - Skilled worker visa is being granted on 29 Feb 2024 and she arrived in the UK on 25 March 2024. So is she applicable for ILR (as per current rule) 28 days before visa is being granted (1 Feb 2029) or 28 days before arrival to UK date (26 Feb 2029)?

The reason for asking this question should extend her visa for 3 years or 2.5 years and only pay IHS charges for 2 years and 5 months if going for 2 and half year extension.

For her visa route, ILR qualifying period starts from initial visa issue date.

An extension will be for 3 years. You cannot choose a lesser validity time. You have to pay IHS for 3 years.

3 years is what is stated in the immigration rules, there is NO discretion.

Hi - My wife visa been granted, as DEPENDANT as i went for 24 hours service.

I have few queries:

My wife first Skilled Worker dependant permission was granted on 29 February 2024. She entered the UK on 25 March 2024 and has continuously remained, and will continue to remain, as Skilled Worker dependant. Her current permission (DEPENDANT) has now been granted until 1 September 2029.



1. ILR qualifying period
As her first dependant permission was granted on 29 February 2024, can the period between the grant of her dependant permission and her physical arrival (25th March 2024) in the UK be counted towards her five-year qualifying period for ILR?


If so, would 31 January 2029 be the earliest date on which she could submit her ILR application, based on the 28-day early application provision, assuming she meets all other requirements (including no absences exceeding 180 days in any calendar year)?



2. British citizenship after ILR

Once my wife obtains ILR (assuming she meets all requirements under the current rules), as the spouse of a British citizen (I became a British citizen on 10 June 2026), can she apply for British citizenship immediately after ILR is granted, without needing to hold ILR for a further 12 months?


My understanding is that, as the spouse of a British citizen, she would instead need to satisfy the three-year naturalisation residence requirements, including:



• No more than 270 days outside the UK during the three-year qualifying period.

• No more than 90 days outside the UK during the final 12 months.

• Being physically present in the UK on the first day of the three-year qualifying period.



Could you please confirm whether this understanding is correct?



For example, if she were to apply for British citizenship on 10 February 2029, would she need to have been physically present in the UK on 10 February 2026?



She has been continuously present in the UK since 14 December 2025 and was therefore physically present in the UK on 10 February 2026.

It's the first visa issue date. Under this route, the date when your wife entered in the UK is irrelevant.

She will eligible for ILR in 2029 under the current rules. There is no guarantee that any advice given now will be applicable then, the immigration rules in the UK are constantly changing.
