Child Born in UK, Tier 2 Dependent Visa Expiry

Hi Experts,

Need your guidance on my child immigration status and what actions do I need to take.
  • Parents were on Tier2 general when a Child was born in UK Oct 2017
  • Applied for Child for Tier 2 Dependent UK Visa (Had to travel to home country) in Jan 2018 which expires in Oct 2020 (since parents can't have more than 6 years in T2 general)
  • Parents received ILR in Sep 2019
I know that the child can be registered as british using MN1, however the question is should the child need to get british registration before the Uk Visa expires on 12th Oct 2020? or will the child get a curtailment? and hence we'd also need to extend the dependent visa?

Can someone please clarify?

Does not matter. Visa expiry will not affect the child’s entitlement to be registered as BC. You can register the child via MN1 even after 12th Oct.

Thanks for the reply.

Apologies if this is dumb, but because the dependent visa expires does it not mean that person has no right to be in the country and hence has to apply for visa extension or since the child is born in uk and hence exempt from it?

A UK born child does NOT need a valid visa to apply for citizenship.

You have had a year to apply for this, why have you waited till the last possible minute? He could have been British already.
