1st British Passport.

Post by Ofm » Sun Aug 08, 2021 11:27 pm

Hi,

Our 3 years old son is European national with settled status for over 2 years with European mother with Settled Status also for over two years and non European father with Settled Status for over 1 years.

His mum didn’t apply or have Settled Status or Permanent Residence when he was born. Now we are planning to apply his 1st British Passport. Would you guys be kind and helpful like always to tell us if our son qualifies for British Passport? If yes, can we do through online or there is another way which we don’t know. Last but not least how much it would cost us?

Thanks for your help & time whoever would be kind & helpful enough to answer this.

How long did you live in the UK exercising treaty rights before the child was born?

Thanks for your prompt response.

More than 5 continuous years, I as a European Citizen worked in UK even though I’ve been living in UK for over 10 years. I have all the records of continuous 5 years work. But when our child became 2 and half years old, I stopped working and became full time mum. This is when I completed full continuous 5 years of work & I also submitted all the evidence at the time of Settled Status. We have never claimed any state benefit.

I hope that I have answered your question in detail?

Was the child born in the UK?

In that case, the child is not eligible to apply directly for a British passport, but must register as a British citizen.

For the child to have been a British citizen automatically at birth and to be eligible for a British passport directly, five continuous years of the exercise of treaty rights by the EEA citizen parent need to have occurred before the birth of the child in the UK.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.
