When does ILR actually starts in terms of qualifying for BC?

Post by Linac Dude » Sun Aug 21, 2022 8:59 am

Hello everyone, I have applied for ILR earlier this year using the priority service. I received the “your ILR application is successful” email on 01.04.22. However, there was a delay with the BRP and after a bit of chasing and escalation, my BRP was delivered on 21.04.22 with a start date of 18.04.22.

Now my question is: when does my ILR technically start? Is it 01.04.22 (email date) or 18.04.22 (date on the BRP)?

My concern is that it’s a sizeable gap, and if possible I would like to apply for BC at my earliest convenience (which hopefully is 01.04.23) but obviously I don’t want to risk it. What do you guys think?

Also, can I get a proper letter from Home Office that clarify when my ILR exactly started? If yes, how do I go about that?

Many thanks.

I would hardly call 17 days a "sizeable gap". Some people get their brps 2 to 3 months later, which is a sizeable gap.

A mere 17 days is noth worth the time and effort of trying to get confirmation from the Home Office. I wouldn't bother. Specially since even with a written confirmation, the relevant case worker can take the date on your BRP, mistakenly or not, as your starting date and complicate matters.

Make yourself a favour, avoid any room for error, just assume April 18, apply accordingly, and forget about it.
