British Citizenship for child born outside of the UK

Post by bgurukishore » Wed Oct 26, 2022 12:20 pm

Hi all,

I need help on below question to get my son born outside of the UK.

I’m in the UK from 2017 and now I have my ILR. My son born outside of the UK in 2011 and he was in the UK on skilled worker dependent visa since 2017 till now.

Please help me to clarify is this right process/steps I’m following,

1) Apply for ILR to my son after completing 5years ( 28 days before his first entry).
2) After 12months from ILR, register him as a British citizen with MN1 form.
3) As he would be still 12years old after ILR and 12months on ILR, I can directly apply his British passport after getting MN1 without any ceremony

Hope these are right process ?

What is the UK immigration status of the other parent?

The child will be eligible to apply for ILR with the second parent.

Once both child and second parent have ILR and the first parent has or is applying for British citizenship, the child can apply for registration as a British citizen.

Children do NOT attend a ceremony.

Child can apply for citizenship once they have ilr, both parents have ilr and either parent is also apply for citizenship at the same time.

Does child has to serve 12 months on ILR before applying for citizenship via MN1 form ?

No. They can apply when at least they and one parent have ILR and the other parent either already has British citizenship or has applied for British citizenship.
