What is the best Citizenship application route for children (born outside the UK) qualified for all routes available

Post by OMARMOH » Tue Jan 09, 2024 8:19 pm

Dear advisors,
My children are due to apply for citizenship after being in the UK for more than 10 years. All of them were born outside the UK and are under 18 years old. They were granted ILR last 12 months. I was reading through MN1 guidance and found out that there are 3 routes through which they can apply for citizenship 1- Children applying in line with parents (I am also applying soon) 2- Children with settlement and residence and 3- Children who have lived in the UK for more than 10 years.

I am currently employed but can’t afford the fees of all the applications (equally not sure I am eligible for waiver application), so route number 1 is not my favourite but if there is advantages of this route over the others please kindly let me know.

I have heard that 10 years route no. 3 is the best even for future, is there any confirmation, please?

Additionally, am I correct in assuming the best section that fits my children’s application is section (3) 2? If not, please kindly let me know which section is correct.

Finally, can you please provide direct links to route no. 2 and 3 unless they have same link (I know this request has been made previously so I understand if you can’t provide it).

Would appreciate any advice on the above matter.

Many thanks for your help!

There's only one application form MN1 - the "routes" are specific sections of the British Nationality Act 1981. You can't really select which is the best route, like you have noted it depends on the circumstances of the applicant. Everything is in the guidance for MN1 - no separate links for separate sections. There's only one fee for MN1 applications. For certain circumstances there may be fee waivers available but probably not for all circumstances. Others could comment for fully on the MN1 intricacies.

Children born abroad are registered under section 3(1) as 'Other - At the discretion of the Home Secretary'.

There is no fee waiver.

The 10 year citizenship route is for children born in the UK who have lived here for 10 years and have had extremely low absences.

Section 3(2) is not relevant to you. This is for children born abroad to a person who is British by Descent.

Thought you were applying for citizenship yourself, as posted on 26th December 2023??

Dear Both,
Many thanks for your reply! All make sense now.

Thanks also for cross referencing the previous post about my application and notice 21. I can confirm that I filled out the application form for myself but have not submitted it yet waiting a confirmation from the second reference. Although there was an option to add dependent applicants in my application form but could not afford thousands of £££ to add my children. However, I am planning to start my children applications one by one on monthly basis so thought I seek some advice about the children applications meanwhile. Hope that is OK.
