Hello,
I am in a state of panic. I fall for a married man unknown that he was. I got pregnant and had a son. Went to child maintenance and DNA was done. It proof he is the father. He has cut all communication with me and the child. He is settled here in UK. I am on a Teir 2 visa.
I would like to get my child registered as a British however his father is not assisting with this.
Have anyone have gone through this before as my child need a passport to travel.
Please anyone help.
British Nationality Act
"(4)If the relevant registration provision is section 3(5), the Secretary of State may,
in the special circumstances of the particular case, waive the need for any or all of the parental consents to be given.
(5)For that purpose, the “parental consents” are—
(a)the consent of P's natural father, and
(b)the consent of P's mother,
If the mother of a person could not actually have been married to the person's natural father at the time of the person's birth (for whatever reason), that fact does not prevent an assumption being made that the couple were married at the time of the birth."
You would be required to submit evidence of paternity. Others may advise further whether a DNA test will be sufficient.
Also, does your child's father hold British Citizenship ?
