Does my child qualify to get British passport ?

Can I apply for a British passport for My son he is 5 years old. He was born in U.K. and when he was born I was on a 5 year visa, and got my ILR after he was born and then I naturalised.
However when he was born his father was already British. His father is not named on his birth certificate. But I have a DNA test which proves he is the father.

His father has refused to sign the passport form to get my son a passport can I still apply for it and use the DNA test to prove that he is eligible?
If not what can I do to get him a passport?

If the father is uncooperative, how will you prove that he is a British citizen? You will need proof of that, in addition to the DNA proof.

Surely if they search for him they will know he is British I have his date of birth?

It is your responsibility to submit the documents. HMPO will not dig around looking for them for you. Apply for a copy of fathers birth certificate.

I could be wrong, but there is, to the best of my knowledge, no central database of British citizens. So, the Home office can't just search for it.

The British citizenship or other immigration status (such as EEA citizenship) of any application at the Home Office needs to be proven for each application.

Depending on where the father was born, contact GRO for a copy of the father's birth certificate if he was born in England or Wales, the National Records of Scotland, or GRO Northern Ireland.

Unfortunately he was not born here.
How else can I get my son a passport does the fact that I'm now British help in anyway?

Yes. You can register your child as a British citizen using Form MN1 under Section 1(3). But that will cost £936.

A british child under section 1 (1), cannot be registered.
