British citizenship/Nationality for my mother

Hi All

I have UK Ancestry visa because my grandfather was British by birth. He was born in UK and served in British Army. He was stationed in IndoPak (before partition of India and Pakistan) and got married to my grandmother in 1943. My mother was born in 1945 and was registered as British citizen in the British Embassy as British Citizen. I have a letter from the embassy in Pakistan stating this.
I have already proved that my grand father was British by birth and due to this I claimed Ancestry visa. Now I love and work in UK.
Is there is any possibility of applying for a British passport for my mother because she was born to a British father who was also serving in the British Army at that time? My uncle (my mother’s younger brother) got his British passport in 1977.
And is there is any possibility for transferring the British nationality to her children.

Your mother should also be able to apply for a British passport.

You may be in luck. You should be able to register as a British citizen using Form UKM. Be aware that any children born to you can not acquire British citizenship based on your registration. Do you have any siblings?

Your case is helped by a Supreme Court judgment from this February.

Yes I do have children. So what will be their status if I do acquire British Citizenship? And also what about my wife’s status? They are all here in UK with me as my dependents.

How old are your children?

Assuming that your children were born abroad and are minors, their UK Immigration status will be the same as the less-privileged parent (in this case, your wife).

After you are registered as a British citizen, your wife and children should switch to FLR(M). After five years on FLR(M), they can apply for ILR. After acquiring ILR, the children can be registered as British citizens and your wife can apply immediately for naturalisation as a British citizen.

No they were Brom in pakistan. So does it mean that they will have to adopt to 5 year route as explained by you? I am not sure if this is the right question or not but I wanted to ask if you can recommend any immigration lawyer who can help me with the applications as explained by you.

Nobody is allowed to recommend solicitors or any other services on these forums, as mentioned in the Terms and Conditions.

You may not need a solicitor. Just start gathering the paperwork (your maternal grandfather's birth certificate, your maternal grandparents marriage certificate, your mother's consular birth certificate issued by the UK High Commission in Pakistan, etc). The documentation for your mother's passport will likely also suffice for your UKM application.

You can try contacting the General Register Office for a copy of your maternal grandfather's birth certificate.

Once you get your registration as a British citizen, come back to these forums and we can guide you further on the FLR(M) side of things.

I understand and I do apologize for asking that question.

Since I got UK Ancestry visa by submitting all proof about my maternal grandfather and mother (maternal grandfather birth certificate and mothers birth certificate issued by church in Pakistan and copy of marriage certificate of my grandparents and a court order from Pakistan confirming the parents of my mother and also government registration documents confirming the family tree which shows the grandparents and parents record for myself) so these documents should be enough? And I also have British Embassy letters dated 1950 to 1960 confirming that my mothers name is registered in high commissions record as British citizens. Will all these documents be enough?
I submitted all these documents for my ancestry visa.

Page 17-18 of the Guide UKM list the possible documents to submit. Have a read through the guide. That may answer some of your questions.

Besides, the fee for a UKM application is only £80.

Hi thanks once again.

So would it be a case (my mothers) under the fact that she was daughter of a British Army office in her majesty’s service abroad or that she was a British subject because she was born to a British father abroad?

I think you can use either, as under either condition, she would have been a British subject born before 1948 and therefore a CUKC on commencement of the British Nationality Act 1948. Due to having a British father, she would have been a CUKC with Right of Abode under the Immigration Act 1971 and therefore a British citizen in 1983.

The link via a British father in Crown Service may be possibly (I am not sure) give you a better shot at the UKM registration, but the fact that your mother was registered at the British Embassy in Pakistan may make her application for a passport considerably easier.

Hi

I have one more question. Regarding my moms application for British Pasaport can you please also guide me what will be the best way for my father to apply/accompany her if she gets the passport. Is there anyway he can apply along with her or may be apply for some sort of visa so that they can travel together. He is around 82years old and it will be difficult for them to stay away at this age now. Is there any humanitarian grounds on which he can apply.
