Citizenship Advise !!!! Speed camera flashing

Hello all,
I got my indefinite leave to remain last week and since I am married to a british citizen I believe I can apply straight away for my citizen.

Last week I hired a car and saw a speed camera flashing (not sure if it was for me or not). Can you please help me with the following:
Since I am on the 3 years route :
I travelled outside the UK on 2018 and again 2020 (1month) less than the required time. Does that count on 3 years prior the application
I had a fine charge cancelled (driving on the residential street restrictions) I didn't mention it during my ILR application do I need to mention it now ???
Incase I got the fine for the speed camera would it affect my application?
Can I travel outside the UK when the application is pending?
I am extremely anxious about this and I would sincerely appreciate your help.

Thank you

Your absences count back from the application date, say you apply on 1/9/2022, it's your absences since 1/9/2019, i.e. three years (not calendar years.

If the ticket was cancelled it was cancelled, doesn't exist.

Well, you'll have to wait and see. You may be offered a speed awareness course which wouldn't have to be declared.
However, if you are given a fixed penalty ticket or fine then it must be declared. Refer to page 17 of the good character guidance: https://assets.publishing.service.gov.u ... gov-uk.pdf
Not sure about the three year rule that's mentioned in the guidance .... but you have to wait and see what happens.
To be refused for driving violations you'd have to be a serial offender, not paying fines, taken to court/found guilty, etc
Can I travel outside the UK when the application is pending?
Yes.
I am extremely anxious about this and I would sincerely appreciate your help.
We've all been there ... please post further queries in this thread which has been moved to the British Citizenship forum.

Thanks for your reply. I really appreciate it. I wanted to ask a solicitor but it's very expensive (£100 for half an hour 😫)

Most people here don't use solicitors - the application is relatively straightforward albeit an expensive one (after all the preceding immigration applications). Best to stay organised, don't rush, get everything as correct as you can. That's half the battle won.

As a UK ILR holder all you need for residency is the stamped passport(s) covering the 3 years period. If you have no stamps in your passport Council Tax bills (with your name on) will be sufficient.
In addition:
- BRP card
- English Test
- LITUK Test
- 2 referee declarations
Please also review the AN guidance (if not done already): https://www.gov.uk/government/publicati ... n-guidance

Thanks for your reply.
For the British referee does he needs to be in the uk for 3 years as well. My friend is a british doctor but he just moved to the UK 1 year ago.
Can he still be my referee?

No they do not. The referee must have known you for at least 3 years though.

One of the referees must be British and over 25, the other one needs to be a professional but no need to be British, read page 17 here https://assets.publishing.service.gov.u ... Guide_.pdf

Unemployed yes - I don't think asylum seeker can be a referee, essentially they don't have status in the UK until approved (unless I'm wrong).

However, the form guidance states for second referee:

"For all applications, the second referee must normally be the holder of a British
citizen passport and either a professional person or over the age of 25."

You nee ONE referee who is British and 25 years or older.

You need a SECOND referee of ANY nationality who is a professional on the approved list.

I am not sure someone who is currently an asylum seeker, not working and neither settled or British would meet the requirement.

Instead of making the application complicated/delayed why not look for another individual to be second referee and avoid all hassles?

Agree but I've asked a lot of people and they came up with excuses

Unfortunately it's not easy to find referees :(

You said you have one referee who is in employment, is their job on the approved list published by the Home Office? If so, you need to find another British citizen over 25 to be your other referee, and this can be anyone that you know, it can be a family friend. Usually the "professional" referee is the hardest one to find.

Why not ask your colleagues at work? That's where the infusion into the British society comes in. It might even be a neighbour you're close to.

Thankfully I found 2 referees. Does the referee form need to be signed before the application or after ???? 1 of them is going on a holiday so she signed it before I submitted my application.

Also, if I used the IDV app for my ILR application do you think I will use it again or there is a change of attending a biometric appointment?

Thank you

Thank you

Hi all,

The HO invited me to use the IDV app. Considering the consent forms
I signed part 1 (as the applicant)
My husband signed part 2 (joint utility bills)

Does he need to sign part 3 as well? Or no

Thanks

Part 3 I believe is to do with sponsors/finances.
Citizenship doesn't have sponsors or financial requirements so not needed.
