Tier 1(E) + Tier 2 ILR - Travel history (UK) refused a visa for the UK

Post by goldenfinger » Mon Mar 18, 2019 3:18 pm

Thanks for helping my previous visa a few years ago.

When I am filling ILR set(o) form, I am stuck on the question ->Travel history (UK)->refused a visa for the UK

My background is my Tier 4 visa was refused in 2009. After I appeal, I won this case. I got my Tier 4 visa in 2011.

My question is: Does my Tier 4 visa belong to refused a visa for the UK when the case won the appeal?

If Yes, what should I know for this section? What materials should I submit as proof? for example, decision letter?

If yes, there has "Give more details of what happened section", How to write this section? Can I write as below
Tier 4 application was refused. After I appeal, I won this appeal and got my Tier 4 visa that the Biometric residence permit is XXXXXXXX.

Home Office Ref: XXXXXXXXX
Appeal Number: XXXXXXXXX

How to write the cover letter for this?

Tier 1(E) + Tier 2 ILR - Tier 1 evidences

Post by goldenfinger » Tue Mar 19, 2019 8:01 am

My ILR application is 2 years Tier 1 Entrepreneur + 3 years Tier 2 General.

I was a sole trader at the time, during Tier 1 Entrepreneur. I only did one-year self-assessment. And then closed account.

What evidences should I provide for a Tier 1 Entrepreneur? There are no documents mention it. I read the previous posts on immigrationboards. A few applications combine tier 1 plus tier 2.

My understanding from previous posts is that DO NOT need to show evidence of investment, but It might be asked if you have not shown your investment before.
The evidence of Tier 1E visa is that you must always have access to the money or invested/spent it during the Tier 1E period.

So, Can I only use Bank statements and a few invoices as proof?

Is there any issue I did not do the self-assessment for the second year and closed account?

I have asked an Immigration Legal Advisor "do I qualify for apply ILR by 2 years Tier 1Entrepreneur(09-2013 to 06-2015) + 3 years Tier 2(06-2015 to present) combination?" I did not hire anyone during Entrepreneur visa.

The Immigration Legal Advisor said:
I have looked into this and you would need to show you have met the requirements of Tier 1 when you apply for ILR and that includes creating 2 jobs. If you can not show this my advice would be to continue with Tier 2 until you have worked for 5 years.
My understanding is I am going apply ILR from Tier 2 General route. it does not require evidence for tier 1. So I DO NOT need to provide evidence to prove I create 2 jobs.

Please help with my confusion.

No requirement for ILR based on tier 2 to submit Tier 1 evidence, but HO certainly can write to you and ask for it.

My case is same as you @goldenfinger. I will be applying for my ILR in June.

I was on Tier 1 Ent for 2.5 years then switched to Tier 2.

The problem I have is that I recently had a pay rise. The price has just now been updated on the SMS. This pay rise is merely 2% (not much). And is way above the £39K threshold of Tier 2.

Will this pay rise have any effect on the ILR application.
So verily, with every difficulty, there is relief.

1. You should post in your own topic as your questions has no relevance to the OPs question in this thread, regardless of the similarities of the combination of visas.
