hi.
i just received my SAR .
i applied post application in time spouse extension before expiry visa. pending 2 months while on 3c applied another private life application.
spouse extension withdrawel after 3 days of private life application. but later HO REFUSED spouse extension. with roa.
now CW type private life application was out of time no 3c . but when i did application i had 3c . can u please help me out here.
private life application granted straight way.

extension applied in time 13 July
private life applied 15 sep
extension withdrawel 18 sep
Ho refused extension 22 September with roa

private life granted 5 December same year
private life out of time how no 3c how.
Ho decided my both application in same time . these all information home office handed me in SAR. SO confusing.

This is what happens when you do things without knowledge and seeking proper advice. There was no need to withdraw the in-time application. The private life application should have been made a variation of the pending application. You instead withdrew the extension. As you cannot make a new valid application while under Section 3C, the withdrawal had to go through so Section 3C ends. Thus your private life application had to be processed out-of-time. However, I believe this should not affect you under long residence (under paragraph 39E)

thanks for reply . i am dumbo person on planet .
see i withdrawel after variation any chance i can save my long residence. but caseworker notes only mentioned refusal. new application caseworker not aware of withdrawel.lol its so confusing.
caseworker not mentioned when extension was refused CW Type pervious application refused with in country roa.
refused 22 sep confirmed
withdrawel 18 sep confirmed
flr fp raised confirmed date 15 sep. out come 5 dec

What extension fee are you asking about?? It is not clear from your posts what it is you are referring to.
