Set O Partner, absences from UK

Post by tej_1234 » Tue May 25, 2021 12:12 pm

Dear Team,

I am making an ILR application for me & my partner and have few doubts. Please assist me to resolve them, thank you in advance.

My partner and I are from India and travelled to UK at the same time on Tier 2 General visa in 2016.
Me - Tier 2 General for 5 years
My Partner - Tier 2 General Dependent for 5 years

Now, meeting all the requirements and having stayed in UK for 5 years we are wanting to make ILR application.
So in Set O application,
I have entered all the details, absences from UK, etc for me
And then have added dependent partner in the same application.
For my Partner, the question comes as below
1. Does the period of stay on which this application was based include any leave granted since 11 January 2018?
--> my answer should be NO, as my partner had visa granted in 2016 itself which is valid upto Jul 2021
And then no question appears to enter her absences from UK throughout the application

--> but if I select Yes, then a new question appears
1a. Have you had any absences from the UK during any leave granted since 11 January 2018?

Is that right? Should I select Yes for 1st question and enter the absences in 1a?
Or should I just enter NO, and then no need to mention absences from UK in the whole application for her?

Please guide, as I am very confused and have to submit my application by this month end.
Looking forward to your thoughts.

Many Thanks.

There is NO absence limit for dependents whose visas were issued before 18 January 2018.

Yes, but the application does not provide an option to enter the absences. So does that mean no need to mention anywhere?

Have you had any absences from the UK during any leave granted since 11 January 2018?
If you choose NO as the answer to the absence question the form will NOT ASK you to enter them as there is no need for you to enter any absences if you never had a visa issued after 11 Jan 2018 :?
