ILR SET M & NO LIUK Pass

Hi,

I am posting this on the behalf of my wife we meet all the requirements of ILR SET M finance, housing, etc, etc, passed the language test

(i`m a British citizen by birth shes indian

Her visa expires within the next 2 weeks and she has failed the LIUK test numerous times on top of this her passport has expired

if she fails this time her FLR-M will expire as there will be no time to take it again (due to the rule of waiting 7 days between each test)

from all the reading i have done its not looking good, what options do we have? my take is that this will seriously impact her chances of being granted the ILR SET M and then the british citizenship

She wont' be successful with ILR if she does not have the LIUL test passed.

She needs to pass the LIUK as a mandatory requirement or else she won't be granted ILR.
There are resources available online that applicants testified of giving them great chances at passing the LIUK test.

shes signed up to all the official online tests, the book, reading forums, upskilling her english but she is just not passing.

i clearly see we are in trouble here, but i am trying to determine what we / I need to do to reduce the chances, of her being deported, additional fees being incurred etc

She simply needs to either pass the test (she can ask to listen to the questions rather than read etc) or she will have to pay for a further FLR(M) extension for another 2.5 years.

It would have been more useful had she planned and tried to pass this at the beginning of her UK residence as LIUK tests don't expire.

Also, why has she not renewed her passport? She needs a valid passport for immigration applications.

WRT LIUK i left it down to her study and pass.. i have realized now she is far too dependent on me, and with hindsight yes it should have been taken a long time ago.

Does she really need a valid passport? I have missed that, why is a valid passport important? our aim was to get the ILR and immediately apply british citizenship

doing some re-reading it appears that as long as she submits here expired passport with other information it will not be dismissed out of hand.

Third party links as per what you required not allowed on the forumthe exact enquiry of yours, others had dealt with with same and got warned. Pointing you to the correct strings to search for is not "sarcastic comments" but providing what can be done within the ambit of the forum rules.

She passed her test, form submitted in time with an appointment booked for 10th Sept for Bio-Metrics / Photo, and presenting of required evidence.

Odd that the website only makes her passport, my passport and the spouse declaration as mandatory, i would have hoped that the

address evidence / financial evidence / council tax would have been requested at the same time, but it is not...

All of this is mandatory and must be submitted otherwise ilr will be refused.

The checklist at the end of the application is generic.

It was a very stressful period, definitely tested my very low levels of patience, especially as i have had to submit everything on her behalf as she does not feel comfortable doing it herself.

Side note - when should she receive an email / letter stating that she is allowed to work until a decision is made? Her current employer has said she is unable to work until she has proof.

The HO actually has a means for employers to check the status of the employee and their right to work. Do I say they are lazy, being difficult of just over the top at covering their backside. The link is below and hassle free

As she submitted before the expiration of her current leave then all rights on that including right to employment/work carries on till decision is made on current application.
