Queries on ILR

Post by umasankark2006 » Sat Aug 21, 2021 12:36 pm

Hi, I have recently got my ILR. My wife and son just finished their 5 year stay in UK under PBS dependent route (Tire2 PBS dependent).
Questions:
1) Is it true that my wife can apply for ILR and once we both got ILR then my son can apply for British passport instead of ILR and then British passport? I heard this somewhere so finding out.

2) Which form I need to use to apply ILR for my wife and son, SET(O) or SET(M).

Thank you in advance

1. No it is not true. Your child born abroad has no entitlement to citizenship or a British passport. The child needs ilr first and can only apply for citizenship once he has ilr and either parent is also applying for citizenship and the other parent has ilr.

2. Set O!
Char (CR001 not Casa)

ILR spouse and child application - Questions

Post by umasankark2006 » Sat Oct 09, 2021 10:59 pm

Hi everyone,
I am applying ILR for my spouse and child.
I have entered to UK on Apr-2016 and I have recently got my ILR.
My wife and son came to UK in July-2016 on Tier 2 general dependent visa.
I have few questions while filling the application , please clarify.

1) My wife started SET(O) application, I hope this is right form.

2) Are you the partner or child of your sponsor?
Should we enter "Partner" ? Who is the sponsor here?

3) In the section "The person you are joining or accompanying".
We are providing my details (Husband details).
a) Which visa is Mr xxxxxx applying for or been granted?
We only get options for Tier2 visa, but I have ILR. I do not have option to select ILR.

b) Do you have one of these reference numbers for Mrxxxxx?
We do not have any reference numbers.
c) If they have one, what is xxxxx sponsor licence number?
Should we enter the husbands last visa sponsor's license number? I am on ILR now , is this still valid information?
Also it says "You can find this information on xxxxxxxx Certificate of Sponsorship (CoS) or Confirmation of Acceptance of Studies (CAS) statement. If you are able to provide this number, it will help us to link your applications together. If xxxxxxxx does not have one or you do not know it, you can continue without entering a number."
Can someone clarify on this?

4) My wife and son received their last visa in 2017. There is a questions "Does the period of stay on which this application was based include any leave granted since 11 January 2018?"
Slightly confused here, should we say "Yes" or "No"? If I say YES it is asking for absence details.

5) What is the ownership status of your home?
Can we say "I live with my family" or "I rent it" ?

6) English language
My wife has completed Msc degree in India. But she does only provisional degree certificate.
NARIC needs final degree certificate.
Should we say "Do you have a degree that was taught in English?" as NO and attend IELRS for UKVI exam?
OR should we obtain degree certificate and get NARIC certificate?

Thank you in advance for your answers in advance, hoping to get the answers soon.

1) You have advised before that is it SET(O)
2) Answer is: partner. The sponsor in this context is YOU
3) Their ILR is based on your previous status as Tier 2 NOT your current status. Provide all the details of your Tier 2 visa
4) Answer NO. This is obvious
5) Yes you can
6) Answer NO. Better for her to sit the SELT exam.

Hi Zimba and CR01,
I am still confused with the question
"Does the period of stay on which this application was based include any leave granted since 11 January 2018?"
They have visa issues in 2017 and expires in 2022. They were out of UK for approx 30 days in 2019.

What should I enter as an answer YES or NO. If I say NO it does not ask for any absences. Where should we mention the absence for 30 days in 2019?

Apologies for asking same question again.

No need to declare it at all. They had no visa issued after 11 Jan 2018. So NO.
This is NOT about absences after 11 Jan 2018, it is about absences if their visa issued after 11 Jan 2018

Thank you,
I have another question
"Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?"

My wife works and we hold joint account, what should I say here ? YES or NO? What they are trying to get out of this question?

To see if you are getting external or third party suppor and hence the need for consent.
