Guidance on Accelerating ILR Process from Global Talent Visa

Post by buntyc » Thu Mar 07, 2024 6:38 pm

Hello everyone,

I need advice on my eligibility and potential routes to securing Indefinite Leave to Remain (ILR) in the UK. Currently, I am on a Global Talent visa in the arts category, specifically under the "promise route" for a 5-year tenure, which commenced in September 2020. Before this, my status in the UK was as a student dependent under a Tier 4 visa from December 2018 until I transitioned to the Global Talent visa. To date, I have accumulated three years on my Global Talent visa.

My husband has successfully transitioned to ILR, having moved from a student visa to a Global Talent visa in the "exceptional talent" category (3-year track) before achieving his ILR. He is also on track to be eligible for naturalization/citizenship in August 2024.

My immediate goal is to obtain a bursary for a teaching program in my area of expertise, necessitating at least ILR status. With a target to secure ILR before September 2024, I'm exploring ways to expedite my path to ILR in light of my unique situation.

A friend of mine, who initially spent two years as a student dependent and then three years under as a dependent on Global Talent visa (exceptional talent route), has recently been granted her ILR. This raises a couple of important queries for me:

1. Could I potentially switch to a dependent visa on my husband's ILR status to accelerate my ILR application? What should I consider in making such a switch?
2. Are there alternative routes to ILR that might be available to me, considering my specific visa history and current status?
Your insights, experiences, or advice would be invaluable to me, especially from those who have navigated similar transitions or possess expertise in UK immigration regulations.

Thank you for your consideration and assistance.

You need 5 years under the exceptional promise route before you can apply for ILR.
My husband has successfully transitioned to ILR, having moved from a student visa to a Global Talent visa in the "exceptional talent" category (3-year track) before achieving his ILR. He is also on track to be eligible for naturalization/citizenship in August 2024.
Exceptional Talent allows ILR after 3 years. This doesn't apply to you.
My immediate goal is to obtain a bursary for a teaching program in my area of expertise, necessitating at least ILR status. With a target to secure ILR before September 2024, I'm exploring ways to expedite my path to ILR in light of my unique situation.
You don't qualify for ILR yet.
A friend of mine, who initially spent two years as a student dependent and then three years under as a dependent on Global Talent visa (exceptional talent route), has recently been granted her ILR. This raises a couple of important queries for me:
This is completely different to your circumstances as they were on a dependent visa for 5 years. This doesn't apply to you.
1. Could I potentially switch to a dependent visa on my husband's ILR status to accelerate my ILR application? What should I consider in making such a switch?
No, it won't accelerate your ILR. Switching to a spouse visa will reset you 5 year ILR clock to zero and a new 2 X 2.5 route to ILR unless you reach and meet the requirements for 10 years long residence first.
2. Are there alternative routes to ILR that might be available to me, considering my specific visa history and current status?
No there is not. Had you switched from Student dependent to your husbands GTV dependent, you could have used 5 years to apply for ILR last year. But you did not do that and can't now go back to that to find a shortcut.
Your insights, experiences, or advice would be invaluable to me, especially from those who have navigated similar transitions or possess expertise in UK immigration regulations.
There is not quick route for you unfortunately. You cannot use your student dependent time to make up 5 years either. The rules don't allow it.
