HELP! Worried about public funds for ILR application

Post by umsi » Sat Dec 23, 2023 3:14 am

I live in Scotland and will be making an ILR application in the next few weeks.

I am subject to NRPF and in 2022, the governments both in Westminster and Holyrood gave out £150 discounts to all households under Council Tax Band A - D, which I fall under. It was called "Cost of Living Award" in Scotland.

Immediately I received the notification letter that my council tax will be adjusted, I contacted Edinburgh Council and told them I was under the Skilled Worker Visa and subject to No Recourse to Public Funds (NRPF). The council rep mentioned they're not sure but will temporarily remove the £150 from by council tax bill and ask the Scottish Government. Few weeks later, she replied that I was eligible and asked me to provide my bank account details for a £150 payment - which I received a few days later. (All our communications was via email which I still have access to).

Not sure what's wrong with me but just started having thoughts about things that could go wrong and now I'm paranoid that I may have accessed public funds.

Please can anyone confirm if the £150 Council Tax Rebate (Cost of Living Award in Scotland) from 2022 is public funds? And will not lead to issues in my application?

TLDR: ILR application coming soon, and I'm worried I may have accessed public funds even though I have an email from Edinburgh Council confirming those subject to NRPF were still eligible for the £150 Cost of Living Award in 2022.

Thanks for your reply.

Please can you point me to some documents I could refer to on this case? Or perhaps should I take comfort with in response from Edinburgh Council?

Thanks.

All explanations are pointers from the councils stating that people paying council tax are eligible and there were couple of similar posts on this forum.
You have this from your local council.

Thanks for your confirmation AmazonianX.

I agree with you. The explicit confirmation from the Council should be enough to allay any worries I have.

Sometimes I get to unnecessarily anxious about important applications, and overanalyze everything.

I'll carry on with my application when the time comes.

I really appreciate your help. Thanks.

ILR - Need help confirming various dates

Post by umsi » Thu Jan 25, 2024 6:04 pm

Hello Folks, need help verifying my dates:

I was initially on a Tier 4 Visa, and later switched to a Tier 2 Visa that was approved on 24/04/2019 (Issue Date on my BRP). The email confirmation from Home Office was on the 25/04/2019.

The Tier 2 expired on 07/04/2021 but I applied for Skilled Worker visa before it expired. Skilled worker visa was approved on 16/04/2021 (Issue Date on BRP same as email confirmation date).

The Skilled worker visa expires on 20/04/2024.

1. Would I be counting the 5 years from 24/04/2019 and not the 25/04/2019?

2. If counting form 24/04/2019, 5 years later would be 24/04/2024. However, my latest BRP expires a few days before (20/04/2024). I know I can apply 28 days before I complete the full 5 years (24/04/2024). Would It be an issue if my current visa isn’t valid until 24/04/2024?

3. To confirm, the earliest day I can apply is 28/03/2024? Full 5 years (24/04/2024) - 28 days?

4. Also, there’s a 9-day gap from when my Tier 2 expired and when the Skilled Worker visa was approved. Again, Skilled Worker Visa application was submitted before the Tier 2 expired. Please can you confirm if my continuous residence wasn’t broken? I've read about the section 3C of the immigration act but I’m not very sure.

4. What are your thoughts on extending the current Skilled worker visa instead of applying for ILR come March/April, because of the tight dates? I would be aiming to use super priority for the ILR if available.

Thanks in advance.

ILR - Sponsor Name different on Payslip

Post by umsi » Fri Jan 26, 2024 7:24 am

My sponsor, Company A is large with thousands employees, and owns many additional companies / business entities X, Y, Z. Companies A, X, Y, Z all work within the same office locations supported by the same HR team.

Company A is my sponsor, but my payslips and reference in bank statements show my salary is paid by company X.

There was even an instance when my payslip showed company X, but bank statement showed company Y in the reference.

Is this a matter of concern for my ILR application?

Just a name on the payslip is not an issue, however, you cannot be sponsored by A and then work for X or Y company, even if they are owned by A.

So, I've had a lengthy conversation with HR, and they've confirmed the license for Company A covers all Company X's employees. That the Home Office was notified about all the entities / companies, and everything was done in according to relevant conditions.

I can also see in the guidance for sponsors, that it's possible for multiple related companies to share a single license:

Chapter L5 of "Workers and Temporary Workers - guidance for sponsors part 1" states the following:
L5.5. If you have a number of different offices, UK-based subsidiaries or entities, locations or campuses, which we call ‘branches’ in this guidance, you can register in a number of ways, including by:

- applying for a single licence that includes your head office and all branches in the UK

- each branch applying for its own licence

- grouping a number of branches under a single licence – for example, a large UK-wide company might find it more convenient to register all of its operations in a particular region under a single licence
Thanks

Help needed with Set O Form

Post by umsi » Wed Mar 27, 2024 11:06 pm

Hello folks,

Currently completing form Set O for Tier 2 + Skilled Worker Visa route and came across this question:

"How many days, weeks, months or years have you lived at this address?"

I'm only allowed to select single unit of date (either year, month, weeks or days).

I moved into my flat on 7 Dec 2019. As such, my possible options are 4 years, 51 months, 224 weeks or 1573 days.

I'm hoping to avoid the days unit due to +-1 day difference depending on whether or not the last day should be included in the calculation. Really don't want to cause unnecessary worry for myself later on.

So, I inputted 51 months but unsure if that's the best option. Please what's the best way of answering this question?

Note that there was a previous question where they asked when I started living at my address. However, in this case the question allowed both months and year inputs, which I found to be very clear. Went with: December 2019. (Perhaps this is why I'm leaning towards months granularity).

Perhaps I'm overthinking things again. Really don't know why they're essentially asking the same question twice.

You are overthinking thinking this. Chose and input by which method you want to indicate. You won't be held down for days and hours and minutes of accommodation occupation.
