Passport expired, can I apply for ILR?

Hi all,

My passport has expired, and I am not able to renew it from my embassy for some reason .. Can I apply for ILR? Is it possible to be endorsed on an expired passport? And if not then what can I do noting that I dont have the option of renewing my passport, and that I am on a marriage 2 yrs visa.

Does the same applies to the dependant passport as well.

I am due to apply but dependant passport is expired, have applied for the new but still awaiting, I dont know what to do, cant be a over stayer and cannot apply without passport???

I have called UKBA, they have advised to include a covering letter that passport has been applied and waiting also include as much evidence to support. If the case will be decided ILR would be issued on paper, and later on new passport I need to apply for NTL but I have to pay NTL fee at that time.

This condition is only applicable if you have not previously taken any LTR on paper (expired passport)

Another advisor (UKBA) advised not to submit premium application as the case worker might convert it as postal.

Please any comments from seniors.

@arfatkhan - submit a postal application on time ie prior to expiry of current leave. try to submit as closer to the leave expiry date and pay by cheque - these will buy you some time.
include covering letter explaining the case and any passport renewal application reference letter that you may have received from your high commission. as soon as you receive the new passport submit that to the UKBA.

I have again contacted UKBA, they have confirmed biometeric after 29th. I asked the question that if one of my dependent have not got the current passport and I have applied for one and still awaiting, should I be issued BRP. She after checking the documents said there is no guidance for the BRP but the information she had for the passport ILRs that the ILR would be issued on a paper for the dependent. Then I have to apply for NTL when the new passport arrives.

Also I asked I am going for a premium appointment, shoudn't it be the case that I will lose my premium fee if the case worker thinks my case is complicated due to not having current passport (for dependant), she said they will check your documents first and if you have all the relevant documents they will ask you to pay and the case worker will look at it. (I am going croydon).

Please share your thoughts on this.

Passport expired, have applied and still awaiting. I cannot leave it too close to my FLR expiry date, and dont know if for now biometric ILR the current passport is a prime requirement or I can have ILR (biometric) provided I have applied and taken all possible measures to renew it but still awaiting. Please could you be able to provide any information? I have PEO appointment booked just 2 days before my expiry..! would it be any problem?

However I suggest postal application as late as possible (If luck favours you for new passport arrival) but before the expiry of leave to remain. Please brother make sure you do not overstay. Submit proof for the application for new passport. I strongly feel that you need not worry much. Postal applications take time and you status stays legal. Even ILR can be stamped on expired passport. Best of luck. Just relax your case is perfectly genuine. Good experience for future to keep checking all documents for their expiry dates.

The only worry is, on this forum some member advised dont leave it too close to expiry date, as say if there is any problem in payment processing or any other issue, your application may risk invalid (overstay), that is why I have booked an appointment for PEO to be certain I appear before my leave expires.

Postal application date is the date you sent it by secure postal mail. Make sure not through a courier as this kind of mail date of application is deemed on the date of receiving of mail by home office.
Secondly send the postal order. it is like a cash so no worry for payment delays
