Emp Letter while on Tier2ICT? Applying as Tier 1G Migrant!!!

Hi,

As per new rule, if I split my absence taken during 5 consecutive 12 months period.
15Mar2013 - 14Mar2012 -> 30 Days (On Tier 1)
15Mar2012 - 14Mar2011 -> 175 Days (On Tier 1)
15Mar2011 - 14Mar2010 -> 34 Days (On Tier 2)
15Mar2009 - 14Mar2009 -> 134 Days (On Tier 2)
15Mar2009 - 14 Mar2008 -> 6 Days (On Tier 2)

Do I need to get employment letter for my absence during Tier 2. I'm no longer working for that company and not expecting to get a letter.

As per the new immigration rules as of 13th Dec 2012, you are required to get a letter from employer ref your absences throughout the time you have been working on Tier 2/Work Permit. But some cases have been approved who later on switched from Tier 2 to Tier 1 G and were not asked for letter for the period an individual was on Tier 2. If you can get it well and good, if you not you should still go and give it a shot

Actually there are few facts floating around:

A. The form says, in 6.2 if you are in Tier 1 ( Applying under ) you need not to furnish any proof of absence.

B. FAQ from Settlement Ops Policy Mailbox says:

Q I was a work permit holder, but will be applying for settlement as a Tier 1 (General) migrant, do I need to provide evidence of work related absences for both periods of leave?
A. You only need to provide evidence for absences incurred during the period of leave as a work permit holder

C. In this forum, many T1G ( previously in Tier2 or WP) got their Visa without asked about the letter.

To, conclude this , I would say, its in line what Gagan said. But, please update your thread when you are applying and share your experience as it will help other.
