My husband is applying ILR after completion of 5 year period (Dec-08 to Dec-13). He was on student visa prior to Tier 1 ( July-05 to Nov-08).
I joined my husband as student dependent in Oct-06 & remained his dependent until Apr-09 when I switched to Tier 1 Dependent, effectively accumulating 4 years & 9 month on Tier 1 Dependent Visa by the time my husband apply for his ILR (Apr-09 to Dec-13
)
Do I need to take extention on FLR (M) or PBS (dependent) & wait for 3 month to complete 5 year period for ILR or I can apply ILR with my husband. Remember my initial Tier 1 dependent visa was granted in April 09.
many thanks for your help.

I believe that you
may apply for ILR with
your husband.
KOL and
B1 also required.

Many thanks vinny. So relevant qualifying residential period for settlement in my case is 2 years not 5 years because my entry clearance as Tier 1 dependent was prior to 2012 ??

Tier1_dependant wrote:I'm a Tier 1 dependent & hold an overseas professional qualification, equivalent to UK Bachelor.
I applied for "English Language Assessment" and NARIC has declined saying they don't consider professional qualifications for the purpose of "English Lanaguge Assessment".
Can I request "Statement of Comparability" from NARIC to use in conjuction with medium of instruction (English) letter
from Institute to prove my English language requirement required for ILR?
Does UKBA recognize medium of instruction letter from college or it has to be from NARIC as well?
A prompt reply will be greatly appreciated.
Thanks

Hi
I am on Tier1 G and due to apply for ILR end of December 2013.
My husband is on has been on his own post study visa and switch to my depandant only in March 2013. By the time I'll apply he will be my dependant visa for 10 months only. However we can prove for cohabitation for the last 2 years. Bank statement on both names, driving licenses on same address etc.
Will it be possible for him to apply for ILR with me.

To my knowledge, a professional qualification will not be accepted for B1 it must be academic.
Degrees taught in English wrote:
Those who have obtained a degree taught in English will not be required to show a formal
speaking and listening qualification.
Those with an academic qualification (
not a professional or vocational qualification) who provide
appropriate evidence that the qualification was taught or researched in English are considered
automatically to meet the English language component of the KoLL requirement and will not be
required to show a formal speaking and listening qualification. The qualification must be deemed
by UK NARIC to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the
UK. However, they will still be required to pass the Life in the UK test to demonstrate their
knowledge of life in the UK.
However, if you satisfied an English requirement for your PBS application that could suffice.
