ILR on 5 years residency???

Hi guys,

I am looking for advice on whether i can apply for ILR on bases of 5 years in UK. I came back to UK after long absence in April 2012 on post study work visa. I then applied for spouse visa in Feb 2013 and got visa in Mar 2013, since then i have applied for second extension and that expires in April next year. I know i can apply for ILR then but i was just wondering whether i can apply now since its been 5 years since i have return and have been away for only 27 days in these 5 years.

No you cannot, for two reasons.

1. PSW does not lead to or count towards ILR based on 5 years residence.

2. You require 5 years residence on a spouse visa to qualify for ILR.

Hi There,

Just a small confusion i have got about 5 Years qualifying period.

First Visa letter dated 21 March 2013
Then Second Visa valid from 30 Oct 2015 - 12 May 2018
I have been absent for 3 weeks only in these 5 years.

my understanding is i can apply for ILR now or do i apply 28 days before my visa expires i.e on 12/05/18.

Your 5 years count from the date your FLR(M) spouse visa was issued.

You can apply within 28 days before this date, so you could have already applied towards the end of February.

Note that fees go up on 6th April.

I wanted to apply now but i was just looking for re-assurance so i don't mess things up.

yes i think i do.

Salary 26k+
UK degree
Life in the UK
2 years plus of Correspondences (4 Joints and 2/3 separate named)
Spouse valid passport and ofcourse mine.

And your currrent BRP card.

Plus very important, don't forget the last 6 moths payslips and 6 months corresponding bank statements.

If applying by post, you don't need to send your spouse's original passport, a copy will be sufficient.

of course i miss all these items. good thing is there is checklist on the form lol.

yes i will applying by post and i wont mind sending passport, better than copying every single page on the passport (just thinking about polar bears ) :P

one more question, please. we used to get printed wage slips and now we receive them electronically. will the print outs be sufficient or do i need to them attested or something?

I sent my documents last week on Thursday but i forgot to send my previos passports. :? i know i should have. how do i sent them seperate. shall i send them to same address with a letter explaining?

any suggestions on this please. Home office haven't received the documents yet. i am thinking of sending my previous passports tomorrow and home office should have it on Wednesday, a day after receiving my original application pack???

i am so stressed now. :|

Hi,

So this morning i rang 0300 123 2241 and asked them what to do. they advised me to send the passports to address in Set(m) Guidance notes which was Liverpool's address. its in the section where it says send additional documents to this address after you have sent your application. Because Durham address is sorting office where they take payments and then pass it to case handlers.

I have sent it special delivery so it will get there tomorrow. hope it will be OK.

Hi Guys,

Just a quickie please. is there any way to request an acknowledgment letter from HO after sending off application. Money was take out week on 5th April. i understand its only a week but i just want to show that letter to my employer and get them off my head basically.

any suggestion?

I am stressing because my current visa expires on 12 May. Still got like a month but do you think i should get it before that on by end of this month.

It takes 3-4 weeks on average
