Please help, Section 3 on a SET(O) ILR has several boxes of which you have to tick one. I am a Thai lady who is married to a British husband and we have a British/Thai daughter. I have done 6 continuous years and I have passed Life in the U K test , but it isn't clear which one do I tick, please help

I don't think you are using a correct form. It should be SET(M) for your situation.

What category of leave to remain have you done 6 years continous of? Discretionary leave to remain (DLR)?

If so, it would be the last one, other
Purpose or reasons... (can't remember the full sentence)

SET(M) is a 5 year route to ILR, where as DLR was 6 year route to ILR of granted before 9 July 2012, after this date it became a 10 year route under appendix FM for family or private life (correct me if wrong).

This would be confirmed if the OP would state what leave to remain she has completed 6 years of exactly though.

Well that has thrown a spanner in the works, I now dont know if I need a SET O or an M. I have been in England since 2005 and I had a visa till 2009 but I didn't renew it as I thought I didst need one. I went to see an immigration help agency and they arranges a 3 year visa in 2012,In 2015 I was given a 3 year Biometric visa and due to that I was told it was SET(O) I needed, is that so ?

My Visa issued to me on 25th of April 2012 was granted Limited leave to remain, the next one was a biometric
visa issued on the 8/ 7/2015 and runs out on 8/7 2018, so which form do I fill in and which box do I tick

It sounds like your where given DLR but you must refer to your documentation for reference of such leave to remain.

Other than that you could do a SAR with the home office to confirm your leave to remain.

Just to reiterate, those granted DLR before 9 July 2012 where required to complete 6 yeasrs of DLR in order to be eligible for an application of ILR, that means 2 grants of 3 years of leave to remain under DLR = 6 years of DLR.

Further more, those of FLR(M) require 5 years of continous stay on this category in order to be eligible for an application of ILR, 2 x 2.5 years = 5 years.

In your BRP card, do you have the statement ''no recourse to public funds''?

No it says leave to remain Work permitted, but no mention of public funds

Normally and from my knowledge and understanding, I think those granted on a Spouse Visa, on their BRP card it would state the conditon of '' NO RECOURSE TO PUBLIC FUNDS'', where as those granted DL and where granted before 9 July 2012 didn't have this condition and where able to have recourse to public funds unless this condition was applied to them of the '' no recourse to public funds''.

Again, you must refer to your immigration paperwork to actually clarify what category it is you where given leave to remain for.

Do you still have access to your immigration documents?

My wife was granted a 3 year limited leave to remain in April 25th 2012. In 2015 she was granted a 3 year leave to remain residence (biometric). She is now eligible for ILR but which form is it a SET(O) OR SET(m) and why, please help

Set(O) if you have held 2 x 3 years Discretionary Leave to Remain.

I have finally worked out, thanks to people on this forum that I need to fill in SET(O) and in section 3 it as which category I am applying, again I have completed 6 years leave to remain so which one do I tick, please help

You tick 'Other purposes or reasons not covered by other applications forms'.

I am applying for ILR , my biometric visa runs out at the same time as my visa, do I need to apply for a new one, or does it come with the ILR

No,

When you apply for leave to remain before your current one runs out, as part of the application process, you will be asked to enroll for a finger print scan at an approved centre by UKVI.

You will recieve a BRP card if your application is successful.

Just for further clarification, your BRP card is your main form of identification for your current leave to remain. Before they were issued as a sticker on your passport.

So dont need to do anything but apply and wait for them to send me info ?

As @CMOSUK has explained above, when you apply for ILR (before expiration obviously), you send your BRP in the application pack including other documents they ask on the form.

Once received by UKVI, they will send you a letter to go to your local post office to enrol your fingerprints/biometrics. The post office will send your Biometric Data directly to UKVI. When UKVI decides to grant you you ILR, they will use that data from the Post Office to make you a new BRP.

To answer your question, yes, just apply for ILR using the correct form, follow the instructions on the form and you should be alright. No need to worry about making a separate application for BRP.

You would apply and include the documentation and information as part of your application, once submitted (before expiry) you will then wait until they process the application, as part of the process, you will be asked to provide your finger print scans as part of their biometric system, failure to provide this will result in your application Being refused or not processing further.

UKVI will send you correspondence on how to and where to provide this, or if they require anything else.
