Posted: Tue Jun 26, 2018 3:40 pm
by ukvisat2
Hi,
I will be eligible for ILR next year 02 November 2019 according to my timeline
01-Dec-14 to 31-Aug-2017 Tier 2 entry clearance
01-Sep-2017 to 14-Sep-2019 Tier 2 leave to remain
My current job Fixed-Term contract will be ending in 31-Aug-2019.
I hoping to get another 6-months extension in my job contract (ending in 28-Feb-2020) .
Will this work for ILR or shall I look for another job with more contract?
Thank you

You need a letter from the employer stating that they need you for the foreseeable future or else you cannot get ILR

I am working in University on fixed-term contract. My line manager is willing to give this letter as we are hoping to get some funding for my future extensions.
Will that work? or the letter should be issue from HR department?

There are no rules as to who must write the letter: line manager should be fine.

You can even consider your first Tier 2 application date as your start of 5years to be on safer side if you like.

My first Tier 2 visa is valid from 1st Dec 2014 and I had applied for the tier 2 visa on 18th Nov 2014.
Do you mean I can use 18th Nov 2014 as starting date?

The residence period for ILR starts counting from date entry clearance visa was issued and not date of application outside the UK.

But it doesn't say anything for inside/outside UK. Pg 9 of 18 of

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application

It doesn't matter, my HR also not saying exact wording but should be ok to say due to review on (date). You can ask your line manager if your fixed term contract renewable or not, if so, you can ask HR to include the wording renewable as well.
