Children applying for ILR - with joint sponsor parents

Hello,

I am helping some friends of mine get their immigration paperwork in order. I'll get right into it.

The mother originally came on Right of Abode and is still on this. The father later joined as a partner. Then 2 of their children joined (both applied in Bangladesh whilst they were under 18). Now they are coming up to 5 years of residency in the UK in September and would like to prepare for ILR.

I had a couple of questions:

1. I tried to fill out the ILR form for Children who initially applied whilst under the age of 18, however, when adding a sponsor it only allows me to add one sponsor, but both of the parents' salaries combined makes up the income requirements so how do I add them both? OR do I add just one, and then when we attend premium centre (which we plan to do) do we provide the details for the second with payslips and bank statements and relationship evidence?

2. Children settling to parents who are already settled one being on Right of Abode and one being on ILR as a spouse of the first, do the children definitely need 5 year residency before applying?

2. Children may apply for ILR as soon as a parent has Right of abode and the other parent has ILR. No requirement to wait for 5-year residency.

If child is 18 or over, then KoLL is also required.

Thank you for this. So they can apply right away as their father just received his ILR. I had one more question does the Income Requirement of £18,600 + the additional for each child apply in this car when it comes to SET(F) application for ILR?

As I was trying to fill out the ILR application and it wouldn't let me add more than one parent as a sponsor on there as both parents make up the Income Requirement. Also, the children are no over the age of 18 and earn their own income too and pay taxes.

Is there any guidance to this with outlined numbers? Currently both parents make around £19K between them. The child how is to be sponsored also makes around £8,000 per annum. Can the child's salary be used in this case?

Hello, Vinny.

So I have gone as far as filling out SET F form for both over 18 children.

In terms of adequate maintenance for two people having leave to remain granted under paragraph 302 - each of the dependents have this:

Both Parents + Dependant 1: A - B = ~£459/week
Both Parents + Dependant 2: A - B = ~£429/week

Either way, the parents were short of around £7/week on adequate maintenance, however, the dependant children have their own incomes to top it up - this can work, right?

Also, since the dependents have their own income, when it asks for what percentage of support the sponsor will provide for each dependent - what would be best there?
