Hi,

Apologies for the long post.
Thanks for the support from this forum I have had so far, I was able to get through the last 4.5 yrs. I gathered immense knowledge from here during my visa extension change if employer and much more.

My situation below..

I was granted visa by company X from 1 May 2014, started working from. 15 June 2014 till end of October 2014. The company was not paying wages properly and I had to represent myself at Employment Tribunal and they agreed to settle. I have I got the P45 which shows 3 months pay and Contributions rest was done as confidential settlement agreement with leaving date as end of October 2014. Checking Hmrc site shows NI contributions paid in full last 4 yrs but 2013 to 2014 the says not in full.. No idea what it means as I joined in June 2014 and if I should be bothered . When looking thru tax pages, The company also seems to have paid as per hmrc 3 months, whilst I was with them for 6 months. But hmrc says no. Gaps.. Dnt know what that means as well.

I been working since November 2014 for this new company Y and had my extension done in November 2017 and is valid till November 2019.

Iam. Planning to go for. Ilr in April 2019 with 2 dependents and later apply for. My newborn a passport based on our ILR

My questions as below..

1.) The company X sponsorship was revoked later in 2015 and was dissolved as per company house in 2016. We had a settlement agreement stating that he would provide positive references for future employment but I would rather not ask unless its required. I never left the country during this period, and I do thave adequate payslips as I want paid properly and they was hence the ET and resignation. Do I need absense letter from that company still or should I just state as per company house its dissolved ??

2.) should I show my P45 and p60 just to add a strong case to the application.

3.) my second visa was granted before Jan 2018 when the new continuous absense rule of 180 days came thru.
I have hardly left the country 80 days inclding 30 plus days when I entered the country, So when I present my absense should I still split the dates as per the new format from Jan 2018 etc.

4.) based on 3.) my wife and first son came after 69 days in July. I know there was 90 days before which they had to come before the absenses counted. Do dependents need to present absenses letters as well??

If the absence were below 30 per residence year, just don not bother. Otherwise write a letter explaining that the company is dissolved

No

What format ?? The rule changes only affect people who want to split a gap of more than 180 days over two years, which you cannot have as you will not be eligible for ILR that way.
4.) based on 3.) my wife and first son came after 69 days in July. I know there was 90 days before which they had to come before the absenses counted. Do dependents need to present absenses letters as well??
PBS dependants whose visas were issued before 11 Jan 2018 have NO absences limit

Date of first entry

Hi Gurus,

Iam applying for for Ilr with my family soon and on the set O form Iam getting mixed. Information regarding *) When did you first enter UK. Iam on tier 2 general and here are the details.

Initial Grant 01-May 2014 for all 3 of us.
Myself - Date of entry - 14th-June-2014
Dependants - Date of entry - 09-July-2014 (came. In before 90 days)

So would the answer be start date of visa 01 of May?

No whereelse in the application it asks when the visa was initially granted so not sure that UKVI would calculate the 28 day to 5 year as around 3rd of April 2019 and I couldn't find anything from UKVI

Put the date of issue. UKVI will calculate the 5 years based on your visa issue date regardless of your answer to that question :!:

The question clearly asks the date you entered the UK and not the date your visa started from. HO, surprisingly, do know the rules and when your eligibility would start.

It will be the date of entry in your case.

The initial visa date is only valid incase you switched inside UK.

Absence Letter From Previous Employer

Hi,

Initial Visa Granted 01/05/2014
Came to UK on 15/06/2014 ( 45 Days After Grant)
Switched Sponsors 10/11/2014 (after Approx 6 Months in country)
No absences during this period outside the country and the company doesn't exist anymore (dissolved)

Going for ILR Next Month. Do I need a absence letter still from the old employer ?

Thanks

Thanks CR001 and sorry for asking again.. Guess the stress of this as dates come closer I guess.

Do I need to specify the list of companies I had worked for in the cover letter and state the first company doesn't exist and I have no leaves while being with them ? Do i need to provide reason for the late entry of 45 Days ?
