I have a question of whether I will be able to obtain ILR on 10 years route. I have given my visa history below -
1. Arrived in UK on 18/05/2010 on Tier 2 (General) visa
2. Obtained Tier 4 Visa on 31/01/2011
3. Switch to Tier 2 (General) visa on 4/04/2016. This visa expired on 14/06/2018
4. Applied for Tier 1 (Exceptional Talent) visa on 1/06/2018. Phase 1 and Phase 2 applications submitted together.
5. Phase 1 (Endorsement) of Tier 1 application unsuccessful on 26/07/2018. Phase 2 Application rejected on 6/08/2018
6. On advice from visa lawyers submitted Admin Review (Phase 2) and Application for Endorsement Review (Phase 1) on 20/08/2018.
7. On 7/09/2018 Received letter from HO that the admin review application was unsuccessful and told to leave UK. We informed HO that we will leave UK voluntarily on our own expense on 7/09/2018
8. Left UK voluntarily on 30/09/2018
9. Came back to UK on Tier 4 (Dependent) visa on 23/12/2018. Our visa will be expired on 17/05/2020.
Currently I am working as a Lecturer in a UK University. Since my arrival in the UK I have worked in three universities and also did a PhD. My wife is a Master’s student in a University. We have a daughter who was born in the UK in 2015.
I have been told by visa lawyers that I might be able to obtain ILR on 10 years route even with the break in my immigration history. It would be very helpful for me and my family whether there is any possibility of getting ILR. Is there any precedence similar to my case?
