Hi,

My FLR(M) 5 year route will run out soon. I have been living in the UK from 3 June 2012 as a student and got married here in the UK in Feb 2014. My husband is British and we have a child. I don’t have the first biometric card period written down myself. But I got a letter from BRP.

Please could you advice me when would be the earliest date I can apply ILR as I am desperate?

My first application date : 6 Mar 2014
Letter date for the first grant to stay : 04 June 2014 (approximately 30months)
First period expiry : ?? Dec 2016
Second BRP start date : 14 Jan 2017
Expire : 25 Jul 2019(approximately 30months)
In total calculated : 5 years from the letter date of the first grant, not the application date.

You can apply no sooner than within 28 days before 4th June 2019.

As all applications are online, don't apply too early as the date you submit and pay online is the date of application.

Thank you for your attention. My FLR(M) 5 year route expires soon. I used old IELTS result on the second period of FLR(M) as I didn’t need to take a test again.

What my question is won’t I need another English exam for ILR?

Apart from two IELTS test results dated 2012 and 2013 which its expiry valid only for two years, I have a professional certificate( equivalent to one level 3) from a professional body in the UK(Chartered institute of Housing) via a College. Also, I am attending a College class for another professional certificate in Accounting (two exams left so far and then I am done).

Useful to state what level your previous tests were. Initial spouse visa is A1 and extension is A2. ILR you need B1. You can also only use an expired test if it was used previously AND is at the correct level AND it is a test and test provider still on the current HO approved list.

Neither of your professional certificate will be accepted for meeting the English requirement.

My level is b2 first which means higher than the requirement of B1.

My question is do I still be able to use one of old exam result for ILR that I used for FLR(M)? I am sorry. I am a but confused.

• the date of application
• the date of decision
• any date up to 28 days after the date of application

So I am actually eligible to apply ILR now as my application date was 6 Mar 2014 which already reached 5 years from the application date.

This refers to the date of ILR application and not your initial visa application date in 2014. It clearly says "counting backwards".

Whe you applied for flr m, your student visa conditions continued until your flr m was granted. Student visa time doesn't count for your ILR qualifying period.

I applied FLR(M) on 4 Mar 2014. However, I rang the Home Office on Monday and one of the staff said the earliest date I can apply is 28days from the date I was granted, not the application date. My letter date was 6 June 2014 saying I was granted. So I think I should wait at least until May rather than trying earlier and being refused.

I left a question on here for my ILR application whether I should take another exam or not but it hasn’t been answered and my enquiry has been locked so I cannot make any further comment.

Please could you help me do I need to take another exam or not?
I took the exam twice(2012,2013)and both of them used when I applied and extended my FLR(M). Now one of the centre(2013) is not listed on the approved centre list.

Thank you very much so I still can use my 2012 certificate. However, the application requires SELT unique electronic reference number. But my certificate hasn’t got this number but instead test report form number. Is this number what I need?
