ILR

Hi all, any help will be appreciated, am applying for ILR with my children and though we dnt have a full 5yrs continuous stay in Uk, I read somewhere in guidelines that children are not subject to absences, anybody has experienced this kind of situation before? And does my British partner need to be working and leaving in Uk before I apply?

Children do not have 5 year residence requirement. They can get ILR when both parents are settled (I assume children are born outside the UK). You and your partner need to prove that you are cohabiting and also you are in a subsisting marriage

Thanks and yes children are born outside Uk, we have all proof that we have been cohabitating and in a stable marriage it’s just that my partner has got new work abroad and has since moved out of UK just last month, though still comes back and forth to visit.
