ILR for dependent

Hi, I will be eligible for ILR in November 2021 via 3 years route on Tier 1 ET visa. I was on Tier 2 ICT visa for 4 years before moving to Tier 1 ET visa. My son will be 18 years old in November 2021 when I will be applying my ILR. At that moment, he will complete 7 years on PBS dependent visa (4 years ICT dependent + 3 years ET dependent). Please confirm that he will be eligible to apply for ILR along with me in Nov 2021.

Are you applying for 3 year accelerated route ?? What is the immigration status of your spouse/partner ?
Children do NOT have a qualifying period requirement. Non UK born children will follow the immigration path of the less privileged parent. Such children can get ILR
only when both parents are settled regardless of how long they have been in the UK. Your child dependant will be an adult by that time so he must also prove that he is not living an independent life when he wants to apply for ILR.

thanks for your reply. I am applying for ILR under normal route. Tier 1 Exceptional Talent visa holder can apply for ILR after 3 years. My wife is on Tier 2 General visa and will finish 3 years on it by Nov 2021. Please note that my son will not finish schooling, he will be in 6th form in Nov 21. please suggest.

PBS dependent child will qualify for ilr when your wife does.

You getting ILR will not benefit them. Your wife needs 5 years under PBS for ILR. Your son follows her immigration path

thanks for reply but please clarify what visa my son should get when I get ILR. He is on my dependent currently.

Your son remains under PBS dependant
ILR application - child turning 18 years

Hi,
I will be eligible for ILR in Nov 2021 through 3 years route on Tier 1 ET visa. My son is on my dependent visa. He will complete 7 years on PBS dependent visas in Nov 2021 with following breakup :
1) August 2014 to November 2018 : PBS dependent with me being on Tier 2 ICT visa
2) December 2018 - November 2021 : PBS dependent with me being on Tier 1 ET visa
My son will be 18 years old in November 2021.
Please confirm that his ILR can be applied along with my ILR in Nov 2021.

Note that if child is over 18 when applying, then he will also have to satisfy the
KoLL requirements under
319J (f) The applicant has demonstrated sufficient knowledge of the English language and sufficient knowledge about life in the United Kingdom, in accordance with Appendix KoLL, unless he is under the age of 18 at the date on which the application is made.
