Tier 2 maximum stay of 5 years 14 days?

Post by cristinepatio » Sat May 16, 2020 6:40 pm

Hi,

I have a question at it confuses me. I entered the UK with 3 yrs tier 2 visa and my employer extended it for another 3 years therefore got 6 years total . In July it will mark my 5th year in the UK and since I still have another year in my visa , my plan is to apply ILR maybe by September instead of July due to lockdown issues of centers being closed down (Life test, ielts test and offices ). Can I do that or it would count as over staying already? should I apply on the exact time that I turned 5 years in the UK? Thanks

It is NOT overstaying!

There is NO rule that you MUST apply for ILR at exactly 5 years. You can apply at anytime when you qualify and before your visa expires.

mistake in some of my PAYE tax calculation

Post by cristinepatio » Sat May 16, 2020 7:54 pm

Hi,

I have notice in the last two years that Paye calculate my tax wrongly sometimes but they tend to readjust it if they have noticed any mistakes. Will this be an issue if I apply for my ILR?

Non-issue.

Can you also please keep all your questions in one topic. It is not necessary to start a new topic with each question you have on the same application!!

Annual Leave format, ILR Tier 2 route

Post by cristinepatio » Tue Aug 25, 2020 2:28 pm

Hi,

My employer gave me letter stating my paid Annual leave but it is in a yearly manner like:
2017-2018 - 27 days taken
2019-2020 - 30 days taken
Etc....

Is that enough or it should be the exact dates of my arrival and departure in the UK? And do I need to include my sick leaves? Many thanks.

Hi,

Thanks, One more question, the employer just stated that " X is employed in a permanent basis and still needed in this capacity" . My question is ,is that enough without the word foreseeable future? Or should i ask them to amend it.

What is confirmation of rate for the job? ILR Tier 2

Post by cristinepatio » Sun Sep 06, 2020 7:33 pm

Hi , I have a question pls, what do they mean with this requirement? As the HR gave me a cert of employment with SOC,job title, weekly hrs, date of hire and annual salary but what could they add to confirm the information below?

*confirmation that this is at or above the appropriate rate for the job as stated in the codes of
practice for Tier 2 sponsors.

Passport validity for ILR application

Post by cristinepatio » Wed Jan 27, 2021 9:52 pm

Hi,

I am due to apply in July2021 for ILR via Tier 2 5 yr route, however, my passport is expiring on December 2021, and all the embassies ang closed and by appointment and the latest one would be on December 2021. My question is can I apply for ILR even my passport’s validity would be less than 6 months? TY
