Good day Experts,

I need your advice on ILR for my spouse and kids. I have read that ILR can be applied 28 days before the 5-year qualifying period. Can you advise which date will be used for counting the qualifying period? i.e. Entry clearance stamp or UK Entry. Below are the dates:
  • UK Entry Clearance stamped: 26th September, 2017
  • Entered in the UK 22nd October, 2017
Also, when I apply 28 days before the qualifying period, Am I eligible for Premium processing for a faster decision? This might mean decision can come in a day (for example: 26 days before the qualifying period)

My info: I came to the UK on T1 Exceptional Talent and became UK citizen in April 22.

Thanks. Ahmed.

Entry clearance grant date will be used.
Using the 28day concession, the date beneficial to the applicant will be used. If in doubt then don't apply too early.

Thanks @AmaznianX. This means I can apply 30-Aug (28 days before the Entry Clearance date)? Can I apply on 30-August using premium services? Please advise.

Thanks, Ahmed.

There is no 'premium in person' service.

You can apply using Super Priority (£800 extra) if the option is available (it isn't always available). Super Priority is a UKVI service. Your biometrics are done by UKCVAS, a third party agent which has nothing to do with Super Priority service.

Thanks CR001 for your prompt response. This means I can apply for my dependants ILR 28 days before the UK Entry clearance grant date, and pay for UKVI Super Priority (extra £800) for next day decision (if the option is available). Please correct me if I am wrong.

Thanks. Ahmed.

Yes. Note however that next day decision is actually a decision within 24 hours after the biometric appointment date. Also be aware that Super Priority is not a guaranteed service.
