Tier 2 to Skilled Worker to ILR

Hi there,
Thank you in advance for reading my queries.
I came to UK in December 2015 first time as student. I moved to tier 2 visa on October 2018 and eligible to apply ILR in September 2023. My questions are as below
1. During October 2021, i changed my employer and have got Skilled worker visa with new employer. I left my previous job on 1st October 2021 and started new job on 9th October 2021. Does this gap affect my ILR application. My BRP for skilled worker with new employer was issued in September 2021.
2. In ILR application, I need to enter my stay outside UK. However I went to several overseas trip since I came first in UK. Do i need to enter all of my stays outside UK when i was on student visa first, then tier 2 visa and then skilled worker visa? or Just need to enter last 5 years stays outside UK when I was on work permit (Tier 2 + Skilled worker)
3. Myself and my spouse visa is valid until October 2024. However I have completed 5 years on work permit in September 2023 i.e. 1 year ahead until my visa expiry. My question is if i switch to ILR then do I need to submit any application for my spouse? She has got valid visa until Oct 2024. She will be eligible to apply ILR on March 2024.
4. If I get ILR in September 2023. Then what application should i submit for my spouse for ILR in March 2024? There is only 6 month gap between my ILR and her ILR. Will that be on same route as ILR via dependent of skilled worker? Does her 5 years period eligibility gets affected if my status is changed from skilled worker to ILR.

No.

The 5 years you are using to apply for ILR.

No change needed.

PBS Dependent ILR on form Set (O). NO, her eligibility does NOT get affected!

Thanks a lot for your prompt response

Please can you confirm
1. What Evidence for my absence in the UK and Crown Dependencies i should submit during my stay in overseas. All of the stays were private i.e. not work related and part of paid annual leaves except one trip which is part of paid leave of 1 week and unpaid leaves of 3 weeks.
2. I have left my previous job. What evidence i can submit for my stay outside UK?

A letter indicating all absences were approved by employer
2. I have left my previous job. What evidence i can submit for my stay outside UK?
No need to provide such for previous employer, only from your current job.

Hi,
As I am eligible to apply ILR now, I am bit confused about status of my spouse visa. Her BRP validity is until October 2024 and she is eligible for ILR in March 2024. My questions is
Do I need to submit any separate application for my spouse now along with my ILR application? OR shall i do nothing for herself until March 2024 when she is eligible for ILR.

No. Her status remains unchanged and her visa remains valid until expiry

For your dependent, you don't need to do anything as her visa remains valid until she qualifies for ILR.

Thanks alot for your reply
For my application i.e skilled workers visa to ILR employer has provided letter as per immigration requirements covering my details, SOC, permanent position, salary rate and mentioned about my total annual leaves entitlement.
My employer has not issued any letter of scheduled annual leave absences from UK. Does the schedule of absences of UK letter is compulsory? I have not traveled for work outside uk.

Letter stating your absences are with their Knowledge/approval suffices.

thank you for your reply
The employer has provided below on the letter. Would that be sufficient? I have also attached my annual leave schedule next to letter.
There is a continuing need for Mr XXX to remain in permanent employment with this firm in the
UK.
Based on the codes of practice for Tier 2 sponsors we have identified the most appropriate code of
practice for XXX role as – XXX- XXX. As Mr XXX annual gross salary
is £XX. we are able to certify that they are paid at or above the appropriate rate for this role.
Please also note that Mr XXX is entitled to annual leave of 25 days per annum. As you will note
from Mr XX schedule of absences from the UK, Mr XXX is frequently required to travel
outside the UK as part of the duties of their employment.

As regularly advised here, stick to the rules and you should be all ok.
