ILR application preparation

Hi
My old post was locked hence created new topic.

We came on tier 1 visa on 12 March 2019 and due to apply for ILR on 13 feb 2024.
I and my partner are applying and my child has visa till Aug. 2024 so we will wait for our ILR and then we will apply for their citizenship. (I don’t have idea how does that work if you could provide me any sort of link where for explanation)

My questions are :

1- is it okey for us to apply without child who is my dependant ?

2- I have one full time employee worked for 13 months. And 2 part time employees worked for about 14-15 months. Since our extension approved.
So hope that should be okey.

3- as we are applying in February is there requirements to submit the accounts for the current year (company account April 2023- March 2024). Or is it okey if we just submit last year accounts ?

4- the documents list going to be same as the extension. Or is there any extra documents we need to add for ILR ?

Yes. A UK born child is entitled to register as British once either parent gets ILR. The child does not need ILR or even a valid visa.

You should read the guidance notes to understand what is required to be submitted.

Which of the above option should I choose for ILR application SET O

Is it Tier 1 migrant ?

Hi

I have 1 full time employee worked for 14 months as marketing manager

I have 1 part time employee worked for 12 months worked as sales assistant

I have 1 part time employee worked for 14 months as
sales assistant.

Basically I created 2 job posts which benefited 3 settled employees.
I hope that should be okey.

Or is it better if I have three job posts ? Or that doesn’t matter as long 2 jobs has been created.

I have one more employee which worked part time with us for 11 months as a cleaner. She is a settled worker too.
Shall I add her too or leave it as per requirements.

You can claim the first full-time position and combine the two part-time positions to make two positions needed for ILR. As they all have been over 12 months then you should be ok

I have asked this earlier but want to reconfirm ;

1- I have account for the year 2022-2023 till March.
And new accounts won’t be submitted before I apply for ILR.
SO is it okey to submit last year account only ?

There is no requirements for the accounts to be submitted in guidelines as per my understandings.

2- Since there is no requirements for the maintenance fund so do I still need to submit bank accounts as I will be applying with my spouse.

3- as I m not going to apply with my child, do I need to mention in cover letter or somewhere the reason I am not making her application. Asking because - in extension application I applied with 2 dependants (my wife and child)

Please advice on above

There is no need for business accounts or any maintenance, also mention why you are not applying for the child on the application.

Hi

My child is born in uk and has visa till August as we do.

So once we get ILR we will apply for her Citizenship straight. I can do that. Correct ?

Yes, a UK born child does not need ILR, they don't even need a valid visa to apply for citizenship.

Do I need to mention somewhere as our last extension was with child and this time we are applying without child.

Incase If they look at my dependants;

Shall I just write down somewhere in my cover letter about my child and reason we are not applying with child or shall I just leave it.

Please advise on it.

Hello Zimba

The reason I don’t want to apply as
If I can apply her citizenship straight when we have ILR then why shouldn’t I save about £2500 applying ilr for her.

But I am not 100% sure if can do that.

My child was born in uk and we applied for extension along with my child as we had to travel. But for now we don’t have any plan. Moreover we got visa till August so we should have reply from ukba by then and even if we don’t my child doesn’t need visa to apply for citizenship.

Experts please advice me : how can I inform home office that why are t we applying with our child

We have been away for about 150 days from uk in total.
Does it affect 5 years in UK ?

we came in 12 March 2019, according to this 5 years completing on 10feb 2024.
So can we still apply on 10feb 2024 or do we need to cover those 150 days which we were absent from uk.

Yes, you can apply on 12th or 13th Feb, which is within 28 days. February next year has 29 days.

We are applying our ILR in 15 feb 2024. We granted visa on 15 feb 2019 and arrived UK on 13 march 2024.
I hope that’s fine to apply by 15 Feb.

Yes mention in a cover letter. No need to attach birth certificate and BRP, not relevant to your application and can create confusion.

About cohabitation documents

‘’If you have added a spouse or civil partner to this application form who is applying at the same time as you, please provide documentary evidence of cohabitation since you were last granted leave (up to a maximum of two years. Evidence provided should cover the whole period and be in the form of official letters or documents. addressed to yourself and your spouse.’’

Can I just upload water bill for last 2 years along with council tax ?

Is it advisable to add the docs for 5 years or I should submit for 2 years.

Secondly,
Shall I add like multiple documents(bank statements, internet bill, mobile bill, electricity invoice etc.)
or 2 of the above will be enough ?

All you need to know about cohabitation evidence

You need to cover the last two years, 3 sources for each year, so at leat 6 pieces of evidence. ANY document can be used

Council tax
Electricity invoice

Below docs on my wife name :
GAS BILL

JOINT NAME :
Water Bill

A:- I hope above docs should be okey for last 2 years.

B:- electricity, water and gas bill has like 24 invoices in 2 years so shall I submit all of them or just like few from each year ?
Please advice on this

Lastly I can add payslip for last 2 years and Hospital letter for my wife. Does it needed if above is not enough.
Shall I add these too.
