Salary requirements for SOC 2421 for ILR

I will be eligible to apply for ILR by end of May 2024, I had first applied for Tier 2 visa in June 2019 and later I changed the job in October 2021. My job title is Senior Accountant, SOC- 2421 , working contract is 40 hours per week. I am not sure about the salary requirement.

For your SOC, the minimum annual going rate required for ILR is set at £33,900 for a 37.5-hour working week. You need to pro-rate this for a 40-hour week to find minimum pay in your working pattern which is £33,900 ÷ 37.5 x 40 = £36,160

Sorry, let me give you the full details. I had came to the UK in Sep 2017 on a student visa and I switched to Tier 2 visa on 20.06.2019, I was working as an accountant ( SOC 2421), the annual salary of £21,650. I had switched employment in October 2021 and my current salary is £36,000 per annum for 40hours per week contract.

I have been told by solicitors that the required salary for ILR is £38,700.

While as per your advise, you mentioned that it should be £36,160.

Could you please clarify.

What I explained above is regarding the going rate. You also need to meet the general threshold and the general threshold is normally set at £38,700 but depending on your circumstances could be lower. Did you bother to read the post I shared above ?

Thank you for your reply.
Yes, I did read the post which you have shared. The salary needs to be higher of going rate or general rate. However, as per my understanding, the general rate of £38,700 is for the COS issued after 04.04.2024?! Hence the reason, I provided the full details. As I am still unsure after reading the post/ links provided, how much minimum salary is required in my case to apply ILR.

In your case, the general threshold is £29,000 and your min going rate (pro-rated lower going rate) as I calculated above is £36,160. So that is the min you need to be paid for ILR as that is the higher value
Tradeable points requirement
Options F-J are available to applicants whose:
• application was before 4 April 2030
• were granted permission as a Skilled Worker under the rules in place before 4 April 2024
• have had continuous permission as a Skilled Worker since then

Why I used the lower going rate?
If you qualify for the standard rate, because you got your certificate of sponsorship after 4 April 2024, read the ‘standard rate’ column. If you qualify for the lower rate, read the ‘lower rate’ column.

Hi Zimba,

Thank you for input and detailed explanations. It has been really helpful. My employer has increased my salary from 01.07.2024 and I am earning above the required salary of £36,150. How long do I need to wait to apply for ILR now? My visas are valid until end of October 2024.

Could you also provide the employer letter format which I will have to attach with my application.

You can apply when you have at least a payslip and the corresponding bank statement.
