10 years rule or human rights law

Hi,
i have been here in the uk for over 9 yrs. i have two kids both born here. one will be six in dec. 2011 and other is 2 yrs old. my visa is going to expire by the end of march 2012. i came to this country in may 2002. I m currently on PSW. I had been on student visa for 8 yrs. its basically slightly more than a month to get my 10 yrs complete. my kid has already started his schooling. I just want to know if you could kindly guide me if would fall under any above rules to qualify for ILR.

dont take chance try to make extenshion for student visa and then apply 10 years role,safe side...

Apply for ILR shortly before your leave expires. If you satisfy the requirements on the date of consideration/decision, then you should be okay.

Thanks Vinny for your prompt reply.

I have just seen the rule 2.2.7 for Early applications and that actually stresses upon 28 days. Mine is almost month and a half, so do you think i should still put forward my application fo ILR.

I think that you should be okay, as it's likely that they will consider your application after to you become eligible.
