Hi guys,
My name is Venkata Naresh. I was first granted leave as a tier 1 general migrant on 01/04/2009 which is valid till 01/04/2012. And i applied for extension on 08/03/2012 in person at PEO and it was successful. But the problem is i got the extension from 08/03/2012 to 08/03/2014. I was told that if i apply for the extension 28 days before expiry of current leave i should get the new visa from the expiry date of old visa which is 01/04/2012. In my case as it started from 08/03/2012 I lost 22 days of my valid visa here and afraid that i will not complete the 5 years qualifying period when i apply for ILR. I called UKBA regarding this they are saying that it is correct as per their records. I have no idea what to do now........should i need to go for another extension??????....

guys...please help me in this regard...

You're still okay. You may apply for ILR up to 28 days prior to the completion of your 5-year qualifying period and before your leave expires.

hi...
thank u soo much for the reply....but there is a practical problem here......according to 28 days rule......i will be eligible to apply for ILR only after 2nd of march 2014 (as my leave first granted on 01/04/2012).......i am planning to get my wife here on dependent visa next month.......i suppose she will be granted leave only until 08/03/2014........and she will not complete the 2 years qualifying period by the time i apply for ILR....so she can't apply for ILR with me.......the only way she can stay here is as my ILR dependent.........if i apply for ILR in person on say 03/03/2014.......by the time i recieve my Biometric residence permit, her visa is going to expire.........is there any way to get her visa done here......rather than going to india and apply.....please guide me how i can overcome this problem......

thanks,
with best regards
