EEA unmarried partner relationship break down advice

Post by Irishwomanxoxo » Tue Mar 28, 2017 1:12 pm

I (Irish national) would like to make an enquiry in regards to an unmarried EEA residence card. My ex-partner who is a Turkish national came to the UK on an EEA family permit as an extended family member unmarried in April 2016. He then applied for a UK residence card.
He was living in the UK with me for a total of 10 months and on the 14.03.2017 I asked him to leave my home and ended the relationship due to domestic violence and abuse towards myself and my 10 year old son from a previous relationship. My ex partners residence card arrived at my home address three days later but I have sent this back to Home Office as he is no longer the extended family member of an EU citizen.
My ex-partner has never had the residence card in his possession and is still in the UK.
My question for you is that it is my understanding that an unmarried partner of an EU citizen does not have right of residence once the relationship to the unmarried partner ends and so where exactly does my ex-partner stand. I understand he is still in the UK and working for the past 6 months.
I understand for the gov.uk website that he no longer has the right to be in the UK and would like to confirm this.
Also what is the next step as I informed home office that the unmarried relationship was over two weeks ago but have not heard anything from them and I know he is still in the uk.
Look forward to hearing from you,

He has no status based on you if no longer in a relationship. Unless he has some other visa or residence card since you split up of course.
