EUSS for extended family - niece

Hello everyone, please help me with my questionnaire. I am eu national with pre settlement status here in Uk . My non -eu national niece came to Uk 🇬🇧 just 2 days ago in a student visa . Can she apply for eu settlement scheme . As I am the one who is sponsoring her in accommodation and her living expenses. And I have a relationship certificate as well that she is my niece . Please can anyone can help as there is eligible category where may be she can apply for a extended family on euss.

As far as I understand:
  • In general terms, the EUSS is out of bounds for extended family members. Extended Family members were allowed in the old EEA regime, but this is no longer a thing under the EUSS.
  • The only provision for some extended family members to still be eligible for the EUSS is for those people who applied (and got granted / or are still awaiting a decision) on an EEA Family Permit having applied before 31st December 2020 or having started living in the UK by that date. This is exclusively to not leave them in limbo since the EEA route closed, so the intent is to allow them delayed entry/application due to covid under the EUSS.
  • There is not a provision to allow non-EU family members to be eligible under the EUSS if they have not applied under the EEA regime or were not residents in the UK by that date. In other words, if a non-EU citizen only attempted an immigration application or came to UK for the first time in 2021 or 2022, then they are not eligible to the EUSS.

Small clarification relating to the last paragraph above: by "non-EU family members" I mean "non-EU extended family members". Direct family members (spouse, partners, children, parents, and grandparents), do still have a route as "joining family members" with some conditions.

But extended family members with no UK immigration history no longer have a route under EUSS, that door is pretty much closed, I'm afraid.
