Was just pondering something today and maybe someone could clarify this for me.

When you submit the initial EEA explication, for the 6 month VISA. It obviously goes through some scrutiny, regarding the proving of a valid/durable/committed relationship.

Let’s assume the British High Commission, agrees that everything is above board and grants the VISA.

I assume all of this and notes for each application and results are all saved on a database of some sort with the British High Commission?

Let’s assume again, nothing has changed regarding the relationship and it’s commitments between the partners etc.

When application is made for the EEA RC, does the whole relationship go under scrutiny again, or do they just look for further evidence of the continuation of the relationship based on what was established with the VISA application?

In summary, would you be granted a 6 months EEA PERMIT from the BHC and then when you apply for the RC actually you stand zero chance of getting the RC, but we’re able to get the VISA?

Indeed I am, and my application has been submitted already.

I was just curious on the matter, everything is above board and I believe even more evident now than when we previously submitted the application in RSA for my family permit visa.

Reason I am asking is because we had not yet filled the 2 yr co-habitation period when we initially did the visa application and still fall short a few months when we submitted the EEA EFM RC application.

I suppose to add, when we initially did the visa application we put in endless amount of support for co-habitation, from council bills, various bank statements, individually and joint, properties co-owned, legal documents etc

My concern is that it was suitable for them to grant the visa but that it may be a stumbling block now when applying for the RC? - If this is the case, then why give us the visa.
