Earliest time to apply for non EEA PR

EU spouse confimed job Dec 2012...start date 21st Jan 2013.when is best to submit application? Now or wait till 21st Jan? Does time during job seeking/awaiting start date count towards PR? Apologies if it's been asked before. ..many thanks Happy new year

If you wait until Jan 21, this it will be a clear-cut case. It's only a matter of a few weeks, so I personally would do it to avoid adding complexity to the application.
Time spent as a jobseeker can count, but requires more documentation to prove than being employed, so I'm not sure the gain in a couple of weeks would be worth the effort of collecting additional evidence. Read page 13 of the guidance notes to see what evidence you would need:

Thank you...yes job was confirmed in Decemberand was given start date for 21st Jan.
