Settle Status application

Hello.

I'm non-EU married with an EU citizen. I have been granted pre-settle status, and my wife has the settle status.

However, atm things aren't going well btw us and we do not live together atm.

I'm aware that in order to apply for settle status, i need de be married for 5years.

Here is my question: As my wife doesn't want to get divorced, and we don't live together can i still apply for settle status after 5years of marriage?

Do we have to live together in order to be granted settle status?

We are technically still married but don't live together...she doesn't want to get divorced.
Regards.

What is your full timeline? When did you get married? When did you come to the UK? When did you start living apart?

Thanks for your reply

Came in the UK in 2011... different visas

Married with eu citizen in the UK August 2017

Pre settled status granted January 2020
My wife has settle status

Started living separately last month.
It will be easier for me if we divorced so I can apply under retained rights (3 years marriage + 1 year living in the UK)
But we are still legally married But don’t live together and she doesn’t want to divorce.

Thanks

Why make things easy when you can make them complicated?
She's making you a favour by not divorcing.

As far as one can read, still being married makes the application to Settled Status straightforward for you: If you wife is still in the UK come August 2022, provided you are still married at the time, and provided you know her EUSS application number, you can apply yourself by providing a copy of your marriage certificate or your EEA BRC if you have one. That's all. No living together requirement.

Check documentation requirements here: https://www.gov.uk/guidance/eu-settleme ... eu-citizen

Thank You Kamoe, I appreciate your effort to reply my request.

I’ll just wait and see what happens by 2022.

At the moment, nearly nothing is tested. As long as you are married on the paper, you should get your settled status.

However, you need to watch-out for any changes. What we know is what's going on today but nobody can predict how rules will change in the next few years.

Hello ALL, i need your help and advices please.

I'm married to EU citizen and going through a divorce atm.

- My ''wife'' has the settle status and i know her UAN (application number)
- I have a pre-settle status until 2025, and also have a BRC.
- And by next year divorce will be pronounced as we both want to be separated.

We were married in September 2017 and have been living in the UK all this time.

We are going through divorce and i would like to know what will happen when comes September 2022 when i have 5 years of continuous residence.

What documents will be needed to apply for Retained rights?
What are the chances to be awarded? we all know that Home office can act funny and strange sometimes.

Thank for your help .

Hello.

I'm Non-Eu citizen married to EU-citizen. My wife and I have divorced and i have the decree absolute.

- We were married in the Uk in September 2017
- We have been living in the Uk since that time.
- Decree absolute 26th February 2021
- Ex- wife has settle status and i Know the UAN number, she lives in the UK still.
- I have the pre-settle status and EUSS card expired date: January 2025

Correct me if I'm wrong please,

From my understanding, i can apply for settle status in September 2022?

I need to prove that we have been married for 3 years and been living together in the UK for 1 year?
And i can prove her nationality through the EU settlement app by using her UAN?

Has anyone applied for the ROR yet? what are the documents needed?

Your help and contribution will be appreciated.

Regards

In your most recent post on someone else's topic, you said your divorced "will be pronounced soon". But you say here that you have a decree absolute. I understand a decree absolute means the divorce is finalised. Which one is it? Are you legally divorced now or not?

Wrong wording, i have the decree absolute, therefore legally divorced.
