I sent my EEA2 application by Royal mail post on 23 March 2013.
Received to UKBA Liverpool office on 25 march 2013. (According to Royal mail Track and trace confirmation).

Bad news September applicants!

Another nightmare with the UKBA. The horror of their behavior after threatening me twice last week saying that they can keep my passport as long as they want and I can't do anything about it because they are not legally obligated. Just to note I sent EEA2, held a student visa and post-study visa here, and my husband is Lithuanian. My local MP wrote a letter, US Embassy has been contacted, European Commission has been contacted, and now I am seeking advice from American law firms. This is a nightmare!

To get to the point, with the third threat I received today, I was told that my application, which was re-submitted in September 2012, has not even been processed. Can you imagine?! There you go September and October applicants still waiting, chances are is that the UKBA hasn't even processed it. When I re-confirmed with him asking again "it hasn't been processed," he tried to step back and say "I meant it hasn't been completed." In all honesty, I bet my left foot it hasn't been processed and is left there in a pile like all the rest of our applications.

Contact your embassies, have your EEA spouses contact the European Commission and their embassies.

Keep insisting your Local MP to write to them and then ask your local MP to ask them details of the stage of the application. Then your mp would get back to you with details of your case .

I did the same, crying over my Local MP in writing 4 times and he did pressure them harder and got feedback about case that they are soon to finish processing. Don't just write to MP once, several time as well, its part of the job to solve problems of migration cases.

I've already done so but even the MP said that UKBA does not always have to write. The US Embassy already made contact. Honestly I've been threatened by UKBA staff, supervisors, etc. Even speaking to attorneys now. The fact I have received no COA as well is unique. Basically without any confirmation written by UKBA saying they have had my application since September, if I get my passport back with no RC I will not be able to enter the UK again without troubles. I've been calling my MP everyday for the past week and a half and after sending it they said to contact again in 10 days as that is what the UKBA is allotted.

I know the details of my case. It has not been processed and I got confirmation that it indeed has not been touched. The MP can only pressure but with the mentatlity of the UKBA having no remorse or morale for violating legal guidelines, all you can do is attack from all sides, which is what I am doing. Going to the MP alone does not help.

The wait is finally over; I have received my RC today. It says on it "residence card of a family member of an EEA national."
Tip: I have waited to go over the 5 month to request my passport. In that case, they probably said that it will be silly to send the passport alone while there is only 1 month left.
But again with UKBA, everything is unknown... This was a very painful and stressful experience. I wish the entire applicant still waiting the very best of luck. I hope you receive yours very soon.

Thank you guys. I really recomand you asking for your document back when you see that the 6 month target is near.
It took them about 10 days to process the application and 19 days to send it. I say if you have passed the 5 months just ask for your docs back.

I recommend asking for the EEA passport, only in extreme case ask for the non eea passport.
They've only issued mine because I've asked for my husband's passport for a travel. Of course is not guaranteed, but it won't hurt asking for their passport.

Yes, I did. But they won't reply your e-mail. They won't say if you're sending something wrong they will just ignore your e-mail.

UKBA lied to Local MP and to me, Jeezy...

I received official letter from UKBA of apology that, they can not find our documents or rather application submitted May 2012. You can imagine how long it is.

They stressed out that, they have instructed special team of investigation to track down our lost application. My solicitor told me, he is going to send a copy of the application sent in may 2012 plus headed paper cover letter requesting them to urgent consider the application, also attaching their letter of apology.

Week ago they admitted to local MP that they are dealing with the case now they say they can not find my application. A nightmare

Congratulations!!! I have sent my application same day as you (if you remember, lol) and I requested our passports back on 10th March, they havent arrived yet so I have just sent another request 5 minutes ago, lets see what happen.
I can't believe that they didn't do anything with your application in 5 months!!! Till you requested your docs back, that's insane!! That means that the application was only getting dust somewhere at UKBA!!
I hope mine is coming very soon.

Can I ask you.. I sent my application on 31st December and got my COA a month later but not a trace of the RC.. do you think I should ask out documents back? We applied EEA1 and EEA2 and I desperately need to travel. Are you married or your visa was based on other situation?
