hello everyone this site is so good.i have bin married to an eea 2006 2011 got divorced applyed to retain my right last year november and they accepted this week but wen they send me the pasport it was 5 year stamp with a picture or vignette in it same us the one i got in 2007 the whole point was after the divorce to retain my right but i still have it on my visa family member of an eea the did not send me a letter to state my status but the same one us ia got in 2077 that if the marriage ends i should notify the homeoffice only letter i got is the confirmation that says that they send the bills divorce decree absolute .i dont understand my selicitor says is frustrating to deal with the homeoffice but he did not say that wen he got paid i dont really understand why they make it so hard wen u can prove the thinks that no human can prove prove paysleeps that your ex wife is working?after all this still the same visa why?can anyone help please or any sugestions thanks

you can apply for PR after complete the 5 years resident on UK,in your case it will be on July 2011 considering your ex was exercising her treaty right from day one of your 5 years residence.
what prove do i need appart from working and all the bills?
the same document you send for retain your right of residence plus document proof that you were working (p60's,pay slips, employee letter)and resident (bills,bank statement, TV licence,some government letters,GP letters ...whatever you can find your name, address and sending date )after end of marriage till you complete the 5 years residence.

thanks again.but i am so confused
my ex is trying to be nice and help me but she cant find her p60 from work.she have bin on the same place working since 2005 she tryed phonin tax office but they saying she will have to get them from her old job
i have 2 thinks i want to ask please if i cant prove her p60 or paysleeps when and how can i apply for pr?cos i bin working since day one and i have all the prove from my accountant and second think is i phone regjister office and they saying that i can apply for pasport,i am sorry to bother u just the whole think is very confusing[/b]

in your first post you said

as i said you have to apply with the same document you applied in November don't add nothing else which concern your ex
but in case you give your ex her p60's back after applied for ROR and she lost them,then you can ask HM revenue give you her work history(she writ letter to HM revenue with her signature)and employee letter it should be okey.

If you cant find P60's or payslips just send an employers letter confirming her NI number and the employment dates. Make sure its on official letter head and duly signed and dated. HO will accept this as proof of exercising treaty rights.
