FLR(M) Partner question

Hello,

hope someone can clarify this for me.

My details:

June 2003-2009 student visa
2009-2013 married to EU national, divorced beginning of July `13
Indefinite leave to remain received Nov `13 based on 10 year long residence

Can I be sponsor to my fiancee and apply under FLR(M) partner route.

We live together for over two years.

I went to solicitor and he advised that my partnership won`t count as I was married with another person for most of the time.

Can someone confirm this please?

You mention your 'fiancee'. Do you intend to marry before applying for FLR(M) or are you going to apply as unmarried partners?

Intend to apply as unmarried.

Marriage will take some time as just got accepted for mortgage and all the funds need to go there

The Unmarried Partner Visa was originally introduced for couples whose national law didn't allow divorce. The Philippines for example.
This was later extended to all unmarried couples who could prove co-habitation for at least 2 years. You shouldn't have a problem with your application as long as you have strong evidence that you've been living together for the required period and meet all the other conditions such as finance and accommodation.
I'm assuming your fiancee has legal status in the UK?
