Hi All,

First of all, my apologies if this have been asked before as I’ve been going through a lot of post for the last couple of days but can’t seems to find an answer. I was hoping someone can give me a bit more information and thanks in advance.

I am currently on Tier 2 Dependant Visa which starts from 15/11/2013 and is valid until 14/01/2016. My wife will be applying for her ILR next week under the 5 years route and I was not particularly sure how I should extend my visa once she changes her visa status.

My first thoughts are FLR (M) but came across this clause stating You must not use this form to make an application for an extension of stay in the following categories:

My question is
1. How should I extend my visa and when should I do it? Should the extension be applied as soon as my wife received her ILR status.

I’m currently in the UK and first enter the country in 2009 on a student visa (Tier 4). I’ve since held PSW and also Tier 2 (was sponsored by my company) until I decided to switch to dependant visa in 2013. I hope I’ve provided sufficient information for someone to advise. If you require further information, I would be more than happy to share them. Thank you.

You can continue to extend your current visa on the PBS Dependent form until you reach 5 years residence.

If you switch to FLR(M), it will reset your clock and you will need a further 5 years (2 X 2.5 year visas) in this category before you qualify for ILR. You would not be able to combine your Tier 2 Dep time in the UK with time on FLR(M) for 5 years residence. It will only be countable for 10 years long residence application in 2019.
