HelloEvery one

I am very new here and just registered today If anyone can please help and provide advice it will be really appreciated

My Case is as follows
I am in ILR since last 3 years and My wife got first visa as a depended in april 2010(in the old rules in which the depended can apply for ILR in 2 years)
But as I was working in company having global business so have to travel and she was also travelling with me and when we went for her ILR then home office said she is short by 6 weeks and have to stay 6 weeks more to get her ILR

And in the mean time she had to travel to India for some urgent work and she applied online from UK and then got the visa in India for 33 months in February 2013,(I don’t know but for soemreason they given her spouse CP visa so the most of solicitors said that as she again made a new entry so she will not come in old rule and she have to apply for FLR(M) but left my old company in January 2015 due to some financial problem in company and got redundancy pay in june 2015 and started new job in august

Her visa is expiring on third week of November so I am not able to show 6 month salary slips so I am planning to apply on the basis of FLR(fp)

So I have the following questions-

Can I apply for FLR(FP) on same day service ? Is it ok ? and if something goes wrong then will I get the appeal right?
Or
Can she travel back to India and then in January when my payslips will be for 6 months then she can apply FLR(m)? But in that case they will restart the 10 years from starting? Because her visa is expiring on November this year

I am very confuse, just because of 6 weeks shortage and confusion she have to wait now long for ILR and also huge amount of money use in this all process

any advice will be really appreciated.

Or do you qualify for Category B or with some savings?

No, she is not working at the moment and in category B i don't have much savings

I do got the redundancy pay of 5000 from company so can we consider it as a income?

If someone can help asap it will be really appreciated
